I doubt if there is anyone at fault here other than the garage.
I agree. The garage have a problem in that they've only received a deposit (part ex) for the car and are trying to resolve it to your friends detriment by getting the car back. DON'T LET THEM!

If she does, she will be the one with a problem - no car and having to argue over the value she receives. As the finance company aren't involved I doubt the car can be seized other than with a court order.

Does your friend or her dad have legal expenses insurance under car or home cover, if so legal advice from them rather than a forum would be more helpful. If not she should contact her local trading standards at council for advice and assistance.

Subject the above, she should contact the dealers and try to speak to the general manager and tell them she will not be returning the car until a satisfactory settlement has been agreed or they have a court order requiring it. Once someone at a senior level at the dealers realises your friend has legal advice and/or TS involved I think they may become more willing to sort the problem amicabably.

I do agree that at the end of the day, your friend won't get a car for the deposit but at the moment the dealer has the problem - keep it that way for now.
