Hi guys
thank you for looking first of all.
I was wondering if any of you may be able to give some advice on a problem I have. Next to my house is a private car park, and on this car park there are two trees that are over hanging my property. First the trees take out quite a lot of light and they are dropping their seeds which is making a mess. But the main problem is that we have had a structural report conducted on the house and the trees are causing an extension on the house to subside. The main problem is that we can not work out who the trees belong to, to approach the people about our problem. I was just wondering if any one else has been in a similar situation? We have rung the council but they were not very helpful i'm afraid.
Many thanks

Thank you for your reply, the main problem is trying to find the owner of the car park. We just dont know where to obtain this information
thanks

I'd discuss with your insurers. To avoid a hefty claim they are very assertive having trees removed (sometimes going OTT in having mature oaks etc. cut down).0

when someones tree of hanging over your property you are entitled to trim the overhanging parts but you have to give them back to the owner, should that principal apply here? Trim and then place in the car park under the trees.been away for a while..need to get on financial track! debts.....Post Grad Student Loan, Northern Rock Loan, Egg CC, Halifax CC, A&L CC, A&L overdraftAllotment plot holder since Feb 2008 :j0

Would it be worth trying the land registry? I think you have to pay for the information, but it looks like you can do some basic searches online. Google "land registry".0

Very true.
Unfortunately, the OP's and the two that are next to my home are huge and would require a cherry-picker as a minimum to get high enough. This is a professional tree pruning job.Marching On Together
I've upped my standards...so up yours!

Yes and that data held by the Council is protected under the DPA.
The OP should contact the land registry office to try to find out the owner of the car park (the searches used to be £25 but you had to supply plans of the plot x 2 (iirc) and outlined in red).
Ultimately though, the OP should contact their insurance providers and they will carry out all the necessary investigations to determine why the subsidence on the extention is happening (and unnessecary ones too!).
They will determine the probable cause and deal with it.
I had 2 very large trees felled that were next to my property some years ago, though it was relatively straight forward because the land was obviously council land. Before the trees were felled though, the insurance company had the drainage from the property checked, twice! by a company that was based over 150 miles away! ???! They then put pins in the walls if my garage and house and monitired movement over 6 months so it was a very long and drawn out process.
Contact your insurance company, thats what you pay them for!
