Debt letter

HI to all,
First time I have used this site but have read with interest some writings on Lowell Portfolio Ltd. My husband received a letter from them regarding a debt with HSBC of at least 6 years old. He has had no contact with the bank for this time and does not now have account with them. We have moved a couple of times and was at one address for more than 3 years. I just wondered why after all this time they have only just got in contact. He has not been in touch with Lowell to admit the debt but now we have had another letter from a solicitor to demand payment.
Does anyone have any advice please.

  • I have a massive post coming up shortly on lowell - I'm in exactly same boat, old HSBC account 6 years 8 months old, they seem to buy statute-barred debt very cheaply, fire letters out on a pitch and miss basis, every sucker that waives limitation act by admitting debt more than pays for those who are cute.
    They will IGNORE your letter of denial/limitation as shown on this site. They will continue to harass you despite this denial and claim of limitation. They use 'Hamptons Legal' which is just a bluff, another of their aliases.
    I've received a SUMMONS concerning my alleged debt on 13/11/06, despite KNOWING 100% I've has no payment or conatact with them since feb 2000 when I moved!
    I BELIEVE THIS SUMMONS IS PART OF THE INTIMIDATION PROCESS AND SERVED VEXATIOUSLY, I HAVE DEFENDED ALL OF IT, AND WILL GO TO COURT TO FACE THEM. 3 WEEKS AGO I WROTE OFF WITH MY POUND PAYMENT RECORDED DELIVERY FOR STATEMENTS ETC AND PROOF OF OWNERSHIP, I HAVE RECEIVED NOTHING!!!!! THEY ARE SUPPOSED TO SUPPLY THIS IN 12 DAYS. IT WILL FORM A VALUABLE PART OF MY DEFENCE WHICH HAS TO BE SUBMITTED BY DEC 10 LATEST, AND THIS HAS BEEN POINTED OUT IN MY DEFENCE. I WILL LET U ALL KNOW THE RESULT OF THIS COURT CASE AND THEIR BEHAVIOUR.

    Hi there
    See one of my previous posts- My husband had something similar. They wrote cryptic letters, then said he owed nothing, then said he did, then said they would forward agreements etc.
    That was 6 weeks ago and nothing heard since.
    Will leave the responsibility on them to make contact- I am not chasing it. Their letters are vague and non specific. I think they hope to bully things from you?

    If your husband has had no written contact, or made any payment on this 'debt', with HSBC for 6 years it is more than likely that the debt is now 'Statute Barred' and therefore uncollectable. There is a template letter that he should send to Lowell Portfolio, in which he does not acknowledge any debt to them and that the 'debt' to which they refer is over 6 years old and is, therefore un-enforceable.
    I will find the link for this letter and post it in the next few minutes.

    Do NOT phone either Lowell Portfolio, or the solicitor - send the letter.

  • Just to update you, lowell never challenged my defence, the case was stayed. Face the bvggers out, if you know you are past 6 years.
