Urgent Help needed Re:Help!! Robinson Way Ltd Unknown Debt
Comments
-
My partner received a 'validation' letter from Robinson Way limited which he followed up (being the honest person he is!)
They claim that they are collecting on behalf of a company (the name which he doesnt recognise) for a debt in 2007 for £52.47 at his previous address (how they got his current address I do not know!)
He informed them he did not know the creditor and would only pay the debt on receipt of evidence of this outstanding balance. They wrote to inform him that they cannot obtain a copy of this agreement and thus means that although they cannot pursue the debt in court they are still entitled to pursue him for the outstanding sums(!!). Does anyone out there know if they can do this!?
They also claim that they can reflect this in his credit rating - again is this possible even if they cannot prove that the debt exists?
I would really appreciate anyones comments on this matter -as I dont know who we would contact to contest this...
 Thanks
 Jen x0

            Hi Jen,...
According to the CCA 1974, they can't do much really (can't do anything in court, nor can do anything about credit rating), please see below and forward to them, which I hope can be helpful to you,
 Regards
 Haydoor...
... thank you for your letter dated XXXXXX...
Please note that I still require you to send me a true copy of the original credit agreement that you allege exists. As you will know, under the Consumer Credit Act 1974, a judge is not permitted to make any enforcement order unless the creditor can provide a true signed copy of the original credit agreement. This means that unless you can produce such an agreement, this alleged debt is not enforceable in law.
To register information with a credit reference agency, you must have written consent from the customer to collate and share such information. This consent is given in the form of a signed credit agreement, so until you produce such an agreement, you may not do this.
The requirement for consent to share data is a clear requirement of the Data Protection Act 1998. any such attempts to share my data without my consent will be met with a complaint to the Information Commissioners Office0

I believe that if they have not contacted you for over 7 years, the debt is written off.
At least thats what my solicitor told me years ago
Perhaps the law as changed i do not know.0
