Never mind the date of the bill, look at the period it covers. If you lived there at that time and the bills were in your name, they have crossed the first hurdle and established that it is your bill. Your only defence now is if the bill was wrong.Hi, we’ve had to remove your signature. Thank you for your reply, I understand what you have said and the period that it covers I did live there however, at the very end of the period that it covers as I was leaving the tenancy and I required a final bill from BG which I am sure that I paid. However, I cannot gain physical access to the final bill to prove as evidence because I may have shredded it as it was a very long time ago. Is it possible for me to call up BG and ask them if I can have access to a formal copy of payment or evidence that states that I requested or paid for this.

I'm no expert but maybe you could send a SAR -Subject Access Request with £10 to BG asking for all the information they hold on your account.0

Hi, thanks for your input, I do not actually know how to send a SAR? In addition, regarding this debt, Robinson Way Limited did not actually provide me with any evidence. They had only stated the billing period of what I supposedly owe and during the end of this billing period I was moving houses therefore I requested a Final bill from BG to which I believe I had paid for. So if they have not provided me with evidence, they have not complied with the criteria of the prove it letter, no? I am thinking to write to them requesting them a letter of proof from BG with the account reference so I can cross check it?0

A SAR is a subject access request, which under the Data Protection Act allows you to a copy of all data that a company holds on you. This would include copies of bills they have asked you to pay and any letters sent by both you and them. You can also request a transcription of any telephone conversations (if available).

SUBJECT ACCESS REQUEST UNDER THE DATA PROTECTION ACT
Dear Sir/ Madam
Please supply me with a copy of all information your company hold on me including a list of accounts and details of payments.
Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, I hereby request that you supply me with any and all historical data in your possession which relates to me and am entitled to under section 7(1) of the Act.
If you store any of the older records on microfiche, please be aware that the Information Commissioner deems this to be a relevant filing system under the Act. As such, any microfiche data must be sent to me in fully legible and comprehensible form.
Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my business with you. Also transcriptions of all telephone conversations recorded and any notes made in relation to telephone conversations by your company.
If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.
I enclose the statutory maximum fee of £10. You have 40 days in which to comply.

You can tweak this to suit, but they should supply you with a copy of all data they hold on you even if it's not in the original format that they supplied it to you with.

But does it have to be 40 days?, I may need the information quick to provide evidence to Robinson Way limited if need be. How do I enclose the statutory maximum fee? cash, cheque or postal order? As you are sending the SAR request to BG it'll be OK to use a cheque but normally a PO is advisable as DCAs have been known to forge signatures!!
Remember, you don't have to provide Robinson Way with anything. Its up to them to do the proof providing, not you. It shouldn't take 40 days to get the info you need anyway. If you subsequently find that you do owe BG pay directly to them by online payment, then you can tell RW to @*%$ off :rotfl::rotfl::rotfl:0
