Hit by uninsured Driver

Hi all,

On Thursday the 9th Sept at 3.30pm I was hit by an uninsured driver, who then proceeded to drive off. I was parked and not in my car at the time. I didn't see the incident but as it was outside a school I have got quite a few witnesses. who have said the car was speeding, and the crash caused them to have a flat!! The registration was taken and given to the police and my insurance company.

I've looked on the DVLA website and have found out the car is on sorn. So no insurance tax or mot.

When I first took out my policy I hadn't had a car of my own for about 10 years, and they wouldn't accept no claims from the policy that I had been included on for that period as it wasn't in my name. So I didn't see the point then in including on the policy protect no claims, and of course as time went by I forgot to add it. (which is my fault)

So now I find myself in the position of, I have had my car hit by some boy racers, my insurance will have to pay to repair my car, and I am going to pay a lot more for my car insurance because of this. It's not fair, why should I be penalised for something that someone else caused by their reckless driving! :mad:

    So if the Police catch up with this uninsured driver and take any action, ask for a restitution order to be granted to pay you the relevant amount. Speak to the Police to find out whether they are taking action and about how to go about this.

    As far as I know you submit paperwork to the court showing the loss that you have suffered and they make an order for the offender to pay you the amount. If they don't have any money, you might only get £1 per month, so you might never get your money back or it will take a very long time. But if you don't ask.
    The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

    I didn't know that thanks :) I can try.

    If the police don't take action, can I take the registered keeper of the car to court?

    The Motor Insurers Bureau should cover your claim.

  • According to what you have posted, the date of liablity is 1/5/11,so it is taxed up to end of April next year.

    No it's sorned.

    It says Vehicle Status SORN Not Due

    Where as on one that is taxed it says

    Vehicle Status Licence Not Due

    Try it on your own car, then if you know of a car not taxed or one that is sorned put that reg in.

    If you embark on court action you have to pay court fees upfront. If you win then the fees are added on to the amount you are claiming, and the defendant ordered to pay you. It's up to you to collect (or pay for collection) from the defendant. So it is no good embarking on court action unless you are pretty sure you can win, and certain the defendant has the funds to pay you!

    In this case you don't yet know if the RO was driving, and will have to prove that first.

    The MIB does have a scheme when the driver is untraced, but there is a £300 excess to pay, so probably you are better to let your insurer sort out your repairs, and hope the driver gets caught.

    Am I entitled to know who was driving the car if the driver has been named. (which I think he has)

    This car is being used on the road :(

    I'd have thought after it hit and damaged mine the police would have seized it!
