car insurance claim query

Bit of a long story will give basics...My sister borrowed my car (she was covered 3rd party through hers) Some idiot in a company van slammed into the side of her causing damage from front to back of the drivers side. She has a video following the van and the damage caused. The other driver did not stop. My insurance is sorting it out through the claim handlers department (i paid extra for it) they have sent out an assessor who said it was a financial write off my car was insured for £850 and they have offered me £750 which i think is a fair amount. The other party are now stating that it was a 50/50 accident and are now not admitting liability, My insurance company then stated that they did not stop, report it to police or contact their insurer until mine got in touch with them.
I have been told i can keep the car (would cost about £150 to repair using scrap yards rather than stealers) if i did this could i sell it and would it be a cat D write off or just financial write off ( i dont what to rip anyone off) Would i be better off scrapping the car?
How long will it take to get my cheque for my car ( i am totally lost without the use of a car because i live a good distance from family and friends)
Can i claim from the third party compensation i have had to pay out for taxi's etc
My sis has a claim in for whiplash along with her son she had her 2 other children in the car aged 5 & 6 well strapped in and well protected the idiot grinned as he drove into her....what a scumbag.
Any help greatfully accepted.

If your sister was only covered by third party insurance, then you need to pursue the third party for any recompense over this. So if liability is agreed at 50/50 this means that you will be able to recover 50% of all claims involved with this incident (including your unavoidable costs, the write off value and your sister's injury claims).
If 50/50 is the case, you will better off keeping the car and repairing it for £150 (and claiming half this back off the third party)0 -
update...... My clever nephew actually took a video of the driver just after the accident. I sent this off to the 3rd party insurance company i received a cheque this morning for the full value of my car. The guy that thought it was fun to ram into a driver with children in the car has been arrested (other motoring offences) as well as not reporting an accident within 24 hours, the video that my nephew took is going to be used in court, have heard that he has also been fired..................in the current climate i would not wish that on anyone but if it makes him a more considerate driver or at least makes him think before he rams into someone else se la vi. (that is of course if he dont end up in prison)0
