Nationwide debt

Hi has anyone any advice?
I have DMP since June. This was done with the CCCS. At the moment all my creditors have agreed apart from one, My Nationwide credit card was passed onto KPR who asked me to pay off the full amount, I explained my situation was then asked by them to speak to family friends or neighbours to lend me the money-I refused. Its now back with Nationwide who have told me they are not going to accept the monthly payment. They applied to the court, I completed all documents and sent copies of my DMP all to the Nationwide as requested
This morning I recieved a letter from court-Judgment for claimant
"The claimant has objected to the rate of payment you offered. You must pay £4193.28 for debt and £10809 for costs total £14,976."
I want to pay all money I owe but if I get costs like this I never will. I don't understand how the court can add extra debt like this Have they not seen my DMP

    I would check if this "court claim" has actually come from a proper court - its not unusual for these companies to pretend to be the court itself and fake these documents to make it seem like it was a court that contacted you.
    It doesnt sound like it was as a proper court would take into account your financial situation first and not just expect you to pay up like that.
    Its not for these greedy clowns to say how much you should pay & when - the court will look unfavourable on them if you have offered them an amount based on your circumstances and they refused it.
    I would also consider reporting them to the authorities for wanting you to get money off family/friends to repay a debt.
    As for the "costs" - these can easily be fought against as well.

    The letter came from Swindon court and court stamped. My only hope is that the court had not been giving all information fron Nationwide e.g. DMP

    When was the judgment?
    I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
    (Ok, one of them is powerless, spiders can be nasty.)


    As of the last count I have cleared

    You need to send a letter to the court asking for a re-determination hearing (like Fermi's letter on Faye's thread).
    As for the costs - were these on the original court documents and did it detail what they were for? I would ask advice of CCCS to see if you can ask for justification of the costs.

    just checked date 8th september and payment starts october direct to Nationwide

    The first court papers had to go direct to nationwide. I did admit I owed the money and enclosed copy of DMP. The first letter said They had added court costs which gave me a new total of £4193.

    I am being asked to pay £14,993 in total. the judgetment states £10800 costs,total to repay £14,993 at £118 per month. where the costs have come from I don't know as this was not on the first claim form
  • Hope you get it sorted - sounds like Nationwide have 'lost' your paperwork. You need to get a redetermination as has been said. It might be worth phoning someone like National Debtline or perhaps even the courts can tell you why costs have been added?
    I wouldn't have thought you would need to go to go court for a redetermination hearing - surely sending in the budget sheet would be enough unless the judge wanted to double check your figures with you etc? If you do have to go to court (unlikely I would have thought when a judge can probably make their own mind up in about 5 mins without having to psychically see you) then it becomes as much about Nationwide asking unreasonable demands / loosing/not receiving your paperwork as you being in debt - being in debt and wanting to pay it back at a sensible rate is not a crime.

  • Since the costs are so different to the original claim, I would phone the court, tell them the situation and ask how you can find out what these costs are. Just wonder if it could be an error by the court??
