they sold car to somebody else :(

I've been looking to buy a used car privately, a lady phoned to say she had one and we had a look at it. However they wanted to keep their old car till their new car was delivered. They also told us they had somebody else interested in buying their old car but we would get first refusal. I emailed her later in the day and said we were happy to buy their car but i wanted to know what would happen if there new car wasn't delivered on the 21st which was the date they had been told, she said she would call the dealership on Monday and let me know if there was a chance the date would be changed.
Today she text me to say that her husband has sold the car to the other person because they didn't ask so many questions!!! I thought the car was ours because i had emailed the day before and said i was happy to buy it. I am really annoyed because i'd spent ages trying to get the cheapest email quote and i had removed all my advertising and i had told everyone we now had a car.
Is it just tough luck on me? They didn't ask for a deposit so i hadn't given them one.

Yup, just tough luck unfortunately
If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

You should have left a deposit.0

This should really be in the Vents forum. What's the alternative to "tough luck on you"? Small claims court perhaps?
"Sir, sir, Maisie said that we were playing for keeps but when I won she said it was only friendlies and took her marbles back."
Sorry!0 -
You should have left a deposit.
i would have done so if they had asked but because i sent her an email saying i was happy to buy their car and she replied that she would get back to me on the Monday i just considered it as mine.
Do you think i would be able to claim back the money i have lost on advertising? as i am going to have to re - advertise for a car.
I thought i may have a leg to stand on since i have proof that i emailed them that i would buy the car on the thursday and she responsed on the Thursday saying okay.wouldn't it be nice if i won : car/cash/family holiday

No,you can't get anything.Next time remember people can be very fickle where money is involved. They probably used you to get a higher price.0

At least they were honest.
We sold a car privately last year. Was sat in the garage and we just wanted to get rid of it as it was no longer needed. We put it in local newspaper. We had it listed for well below what we should expect for it...I mean like 30% below the going rate for similar vehicle.
We had about 30 (no joke) phone calls when it was printed just in the morning alone. First guy called agreed to look on same evening. When he turned up I took one look at him and thought to myself "this is going to be fun". 2 hours he was there. Asking mundane crap like what guarantees I can give him it will still be working in 6 months time? (It had 8,000 miles on the clock !!!!!!). Would I be willing to find a receipt for the car kit we had fitted? Then I had about a thousand questions like "what if XY&Z happens". In the end it was obvious the guy was a pr1ck and was wasting time. He's the sort of guy that if an interior light stopped working 3 years down the line he'd be ringing me up expecting me to fix it. I just said "look, this is all a great big waste of time. I'm going to call the next guy on the list". He departed, I called another person who had called my mobile in the morning, him and wife turned up, spent 30 mins with a cup of coffee, then went home beaming smiles and one of them in their new motor.
I'm guessing you were just too much hard work for the seller.0 -
