  • Thank you for your help. We didn't dispute the damage as such, (we did repair it but the landlady wasn't satisfied) but we weren't happy with the amount charged. The letting agent left us a message on our answerphone saying that she had released the deposit minus the amount for damages but by the time we could call her back she had already released the deposit and it was too late to challenge it. It was mentioned in our contract that the deposit would be held in a scheme but we did not receive confirmation of this.

    I agree with Bitter&T & TBS...

    Might be worth writing/emailing the landlord, copy to agent, keep a copy a polite calm letter requesting details of where the deposit was protected & reference number and that you dispute the deduction and withheld rent & look forward to receiving their cheque promptly in settlement.. See what reply you get. If reply isn't acceptable (or there is none) post again and hopefully you'll get further pointers..

    Agents & LLs behaving the way you have described need a good kicking, IMHO.

  • I, foolishly, never checked about the deposit as I just assumed that what was written in the contract was notification enough. As we moved out on the 29 July and have received the remaining deposit back already, are we too late to challenge the deductions?

    We did not receive a written list of deductions - just an answerphone message detailing the quote for the work and to say that the letting agent had released the deposit. Is a written list a must if the deposit was protected?

    The receipt for the rent overpayment just states "Days payment (change of rent day)". It was paid to change the rent due day from the 30th of the month to the 2nd of the month. I guess as it was paid for the purpose and not an admin fee, it is the LL's responsibility. When I queried when we would get the overpayment back, the letting agent told me any overpayment would be returned automatically with the deposit (which it wasn't).

    We know we should pay to repair the damage, we just feel that the quote was excessive and included repairs to the item in question which we did not damage. We just want to be fair and get our 40 odd quid rent overpayment back!
