Hi Everyone,
About a month ago I received a letter from MBNA with the usual friendly threats of legal action. I sent them the standard letter I found on this forum with an the additional information that this was the second time I'd done so. I included a copy of my bankruptcy certificate indicating I went bankrupt on 1st July 2010, for the second time.
Just got the post through and have received another, incredibly threatening this-is-your-last-chance-to-pay-or-we'll-take-you-to-court-letter.
This debt was amassed originally about ten years ago when I was young and very stupid with an Alliance and Leicester Credit Card (5k in total). At some point MBNA took over (or perhaps always administered the card under the umbrella of A and L).
Couple of questions: 1) Is the fact that I put down A and L on my bankruptcy forms and not MBNA for this debt causing them to ignore the fact I'm bankrupt. The address I provided was for MBNA?
2) What should I do now, send them a third copy of my bankruptcy certificate?
Thanks in advance,
Hanky

Hi Hanky3
We had a similar problem with MBNA and I posted here about it at the time https://forums.moneysavingexpert.com/discussion/2266231=
The letters eventually stopped without getting the OR involved, but the thread contains a useful template letter posted by Doucam you might want to use.
Good Luck.0 -
I would just ignore it, if and it is a BIG if, they do take you to court the Judge will not be very happy with them wasting the courts time.:pB&SC No. 298

First i would give them a ring, alot of these are generated automatically, so i would ring the number on the letter and point out the letters yo have sent and where they contct the OR. If they get nasty just put the phone down and forward on to the OR. At least then you have tried, sometimes all these things happen automatically and as soon as you speak to a human it gets sorted, sometimes not of course but give it a tryHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.
Please note that any views i put forth are not those of my former employer The Insolvency Service and do not constitute professional advice, you should always seek professional advice before entering insolvency proceedings.0 -
That thread has put my mind at ease. MBNA should know by now about my bankruptcy and the fact the other former creditors have stopped hassling me must mean the OR have contacted them.0

Would phone them but currently on JSA and an 0845 number is out of my budget. Would it be worth popping into a branch or would they try to set fire to me and lock me in their dungeon?0

http://www.saynoto0870.com/ try this for an alternative phone number0

or would they try to set fire to me and lock me in their dungeon?
That's always a worry!!!!
Personally, I would ignore them. If you feel you need to then pass the letter on to your OR and ignore anymore. They are simply using this transition period to ignore your BR and hope they can force some payment from you. Expect to suddenly get letters several years down the line.
There is nothing they can do. The debt was included in your BR so there is nothing they can do to you at all.0 -
This happened to me aswell, I told one of them on the phone to go ahead and take me to court, I went on to say that they will know who I am as I will be the one laughing his head off at their stupidity before the judge gets annoyed at their blatant wasting of the courts time.0
