Splitting cost of repairs to the freehold

Hi all, would be grateful for some advice with the following issue.

We've recently bought our first flat, its a leashold within a larger freehold property, of 3 flats in total. Following the survey, we need to make some repairs to our flat, including the roof section and a new damp proof course. As the roof and the walls are part of the freehold, our lease states that all freehold repair costs are split between the 3 flats (there is no freehold pot of money with which to pay for such things).

We have contacted the other Leaseholders to let them know that we will be doing these repairs, and that costs will be split. However, one of the Leaseholders is currently selling her flat and has just accepted an offer.

Who should be responsible for the costs to her flat now? Should she still pay before she sells the flat, or should she let the new buyers that they will be hit with a bill from us soon?

Any advice would be great! The Freeholder is keen not to get involved and would like us to sort out all repairs between ourselves.

    I'm afraid it is the freeholder's job to get involved. Do not do any work til you read this website www.lease-advice.org

    Your should inform your freeholder, in writing, of the problem.

    He then needs to serve a section 20 notice of intended works on ALL leaseholders, giving them a change to make comments or to get their own quotes.

    If you do this, the new purchaser of one of the flats will be informed properly. Then it's up to them whether they pay, or negotiate with the current owner, for the purchase price to drop.

    If you, or your freeholder, don't go down the section 20 route for major works, you will not legally be able to get any money, over the £250 statutory limit per leaseholder.

    Out of interest, which floor are you on? How come 'your' flat needs repairs to both the roof and the dpc?
    We have contacted the other Leaseholders to let them know that we will be doing these repairs, and that costs will be split.

    VERY optimistic of you!

    If you approach the other 2 leaseholders and they decline to contribute, there is nothing you can do. Only the freeholder can require repairs/payment.

    If the freeholder is not interested you have a problem.
