Tesco Price Promise Lie...

I just pre-ordered 4 blu ray dvd's from Tesco Entertainment.

There were a pre order purchase as they aren't released yet... great price of £3 each...

But since ordering them they have sent emails for each one cancelling them.
No reason why ....

with a statement underneath explaining their so called price promise..

"Price Promise
All pre-order products are subject to our Price Promise. This means that if the price changes before the item is released you will always be charged the lowest price. If any of your items are reduced in price by the time your item is despatched we will send you a final price confirmation email with the actual price your card was charged."

When you go to there website and look up the exact same pre ordered blu rays they are now £20 each....

How can they be allowed to do that... It is not a price promise... more like a Price Lie.

Price has changed so they cancel your order so they dont have to honor their so called price promise...

There must be some sort of law about this misadvertising and false promises...

  • The blu-rays were obviously priced wrong, they noticed the blunder, cancelled the order and told you so.

    It's perfectly legal, as they had not dispatched the goods to you.

    Think logically, would you honestly get NEW blu rays for £3?

  • LOL... yeh that is why I ordered them... but feel they haven't honoured their so called price promise. They made a mistake, they should be made to uphold their Price Promise. They shouldn't have it if they dont like it....
  • Yea you'd only really have a case if they had taken payment for them. Even then they could still argue that it was a mistake.

    You could emailing them, they may send you some sort of voucher code as goodwill

    Not exactly true. Under DSR's a contract doesnt technically exist until payment has been taken AND goods have been dispatched.

    The company are perfectly within their rights to cancel up until this point without any penalty. The reason for this is that in a shop, you would offer payment and the employee would accept/reject your offer.

    When ordering online, it is done so automatically and they have technically not had a chance to review the customers offer and accept/reject it. This is usually done before dispatch. And in this case, they have done so and rejected the offer so no contract exists.

    Furthermore their price promise is for ordering things that may go on sale or reduce in price. Or would you prefer their policy to be "we'll charge you whatever price it is on the day it is dispatched.......regardless if its more or less"?

    If you read their T&C's you will probably find a section with regards to pricing errors/website errors allowing them to cancel in the event this happens.
