STAMP DUTY on house + building plot

We have put an offer in for a house with a building plot which were being sold together or separately. Anyway, we put an offer in for asking price for each. This was accepted. What we want to know is, now the combined total is over the £250,000 mark do we have to pay 3% stamp duty or can we take them as separate transactions and keep to the lower stamp duty. If they had been sold to different buyers the building plot would have had no stamp duty. It seems a bit unfair when the seller was willing to sell separately and we put an offer in at the asking price for each.

We have a situation where we wanted to buy a property with a bit of land. They are registered separately. We asked our solicitor if we could purchase them as 2 plots to avoid the stamp duty, but he said to be careful as it would be classed as an "associated sale". ie, if they saw it was you who bought both bits of land, they would think there were fishy things going on and start asking questions why they were sold separately.... Not sure if it would be the same in your case as they are up for sale individually. Can you check with your solicitor?0
