Amazon Seller Refunds

My DD bought a game from an Amazon seller which arrived this morning. It was described as having 'a few scratches on the disc'. It doesn't work, you can't get past the initial game company screen.
I have emailed the seller to tell them and just wanted to know what I should expect next.
Can we expect a refund of the price inclusive of postage? It wasn't very expensive but my DD is upset.

Just a tip really.
A few places locally have a machine so that they can get rid of the surface scratches on the disc and make it playable. Have done it with a couple of music CD's, and I know it is possible on games.
My local place charges £2.50. I know the chain Choices has the facility as well. Maybe worth a go if you have to pay return postage costs anyway?0
