Landlord is going bankrupt in two weeks

Hi,

When we moved into the property we were told that our landlord had no debts (our landlord is my partners mums boyfriend's brother) after a month we had a bailiff come round and letters, landlord said he would deal with it, he went to court and he was repaying the debt. We had bailiffs come round during the six months we were there and we were always told that it was dealt with.

Landlord stopped communicating with us two months before we moved out, all our communication is through his brother. Landlord is very secretive all we know now is the city he lives in and an email address, he has told us a bunch of lies.

We moved out on the 30th August we gave him a months notice again he did not communicate with us we went through his brother. We have kept asking for the deposit as the house was checked and everything was in order. At first the landlord said we would get our deposit £500.00 per week for three weeks. He said yesterday after we questioned his brother that we would get £500.00 every month for three months. He said this was because it was in a high investment account.

We said that did not sound round and demanded it back. We have more than £1300.00 as the deposit. We have since found out that he is in debt by £200,00.00 and was going to file for bankruptcy next Tuesday, his brother talked him out of this, instead he is going to file for bankruptcy in two weeks time.

If he files for bankruptcy we are never going to see the deposit money again? Where do we stand legally?

Sorry this is abit jumbled it has been a stressful day.

    Oh dear, if only you'd asked us for help 3-4 months ago, we'd have told you to stop paying the rent as you don't have his address ... and then we'd have asked if your deposit was safe and in a Deposit Scheme.

    I don't know about bankruptcy, but others will be here in a short while that will.

    What a rotten bit of luck ... all the bad things we'd have suggested you do to him can't really touch him much now you've moved out and if he goes for bankruptcy.

    Contact shelter & ask for advice...
    Housing problems can affect anyone. But many people can find it hard to go for advice or just don't know what help is available.

    Shelter provides a free, national telephone advice line staffed by trained housing advisers. We have helped thousands of people, from finding them a place to sleep to suggesting how to handle mortgage arrears.

    but they are a charity & have not enough resource so you may have a wait...

    If possible talk to/write to the bank/mortgage company & explain what's happening, say you are happy to pay then rent & are good tenant etc etc.. They just might be flexible...

    I'm really sorry: What an a*****e!!

    It may (sorry..) be sensible to present yourself to the council housing dept as "Imminently homeless". Take copies of bailiffs letters etc.. Council often try to wriggle out of theirm responsibilities but they have a duty to help people in similar circumstances to you...

    If he becomes bankrupt you may never see deposit again, but finding a safe home I think may be the priority..
