IVA and Medical Negligence Claim Payout
Hi All,
I am in an IVA and all going well, such a life changing relief!
Whilst applying for an IVA I entered into a Medical Negligence claim via a solicitor [long story]. I told the IVA firm several times during the process and each time I asked what impact the potential payout would have they would always respond with 'it depends'.
Without wanting to bug them again does anyone have any experience of getting a medical payout whilst on an IVA. I understand I will get to keep some of the compensation but its all down to the breakdown of the payout, i.e.
- Loss of earnings
- Pain and suffering etc
As I am employed by a large corporate I did not loose earnings so I was wondering what categories of payout I get to keep and what goes to the IVA?

Someone was posting about something similar on here recently.
What we discovered is that it also seems to depend on which cmopany you are with.
Pain and Suffering is exempt in bankruptcy - so the company I work for also exempts it in an IVA but the poster asking about this the last time was having difficulty sorting this out with their IP. Their IP wanted HALF the Pain and Suffering which to me made NO SENSE. It's either a windfall (so you pay all) or it's exempt (so you pay nothing).
So basically it seems it CAN depend on the company. Might also depend on how strongly you feel about it, if you think you're in the right then stick to your guns and argue your point.
But consider this, do you CURRENTLY NEED the compensation to help comfort your Pain and Suffering?Would you ask the wolves to look after the sheep?
