late direct debits

bit off topic but im hopeing someone can help me. My son goes to nursery. His fees are ment to come out of my account on the 1st of each month. Today is the 9th and the money still hasnt come out of my account. Where do i stand with the nursery on this? Have they broken there contract by not taking the money? The money is in my account but hasnt even been requested. Many thanks

How about speak to them yourself? We can't do or advise you anything about it, you haven't paid it so obviously there is an issue, speak to them.

Do you have a copy of your contract with them? I don't.

It's most likely that you have broken the contract by not paying ;) .

Look, this is simple, talk to them - something's gone wrong (not on purpose) and it needs fixing.
  • Direct Debits are taken “on or after” the specified date. Usually that means a day or two later (particular if the DD falls on a weekend).

I presume, the nursery has taken the money in previous months (it is not a completely new DD?) - In this case, something has gone wrong. As long as the money hasn’t been taken, you still owe it. Neither you, nor the nursery is in breach of anything.

So advise them of that gremlin in the system, if you want to avoid the money being taken out weeks or so later.
