Barratts losing interest.

I bought a townhouse from Barratts in May 2007. Since moving in there has been an issue with damp coming into the attached garage. Barratts have been responsive to my complaints in relation to this and they have sent their groundworks contractors to my address on three occassion to rectify the problem.
Unfortunatley this problem still exist (as it does with my neighbours house). It would seem that the groundwork contractors are not able to solve/fix the problem.
I have had a meeting today with Barratts and also the groundworks company. I got the impression that both were tired of trying to deal with the issue and they simply wanted it to go away.
I was amazed to here the representative from Barratts state 'we cant guarantee that you wont have damp in your garage when you buy a house from us'.
Now you can imagine my shock to hear such a claim. When I bought the house I cant remember signing anything to say 'I am aware that my garage may be damp and there will be nothing I can do about it'.
Has anyone else had any experience similar to this or can anyone offer any advice on where I can go from here. I have spoken to the NHBC but as it is an ongoin problem (that I reported withing the first 2 years) they would not get involved.
