car warranty problems

any advice please, bought a secound hand car on june 30th from a large main dealer and payed over the odds for the security of a full 1 years warranty. After 6 weeks august 15th the car developed a major problem, we were recovered by the breakdown assist that was also included and the car taken to our nearest main dealer(not purchased from them). After been given a hire car for just 3 days they took that back and our car is still sat in garage wanting a new engine. No one seems to be responsible and the warranty compnay are saying paperwork from purchase garage is not in order so we arent covered. Almost a month later and no progress, no car and 10k sat in a dealer yard!

    What correspondence have you had with who?

    Who is the dealer? Who is the dealer you recovered it to? Where is it now? What paper work isnt "in order"? What have the dealership said about this? How did you pay? What do you want, refund, repair?


    We need a lot more info......

  • i dont want to start naming the dealers and manufacturer involved yet. The paper work is to do witht the service that was carried out before we collected the car, the warranty company says it isnt sufficient but the dealer says he doesnt know what they want. We payed 1k on credit card and the rest via switch when we collected the car. We just wanted the car repairing but as time passes a refund my be better as we are getting pretty fed up with this particular car company and are sick of doing all the chasing and phoning round after them every day

    There no issue whatsoever in naming and shaming. Its encouraged. Its only ever an issue if your made everything up (ie libel).

    Id just go to the credit card provider and ask them to carry out a section 75 (of the consumer credit act) claim against the purchase. This act makes them (the CC company) "jointly and severably liable" for the goods conformity to contract.

    They are legally obligated to refund you as the goods are obviously faulty.

    You could chase a repair through the dealership but it sound like it will be much harder and take longer.
