I've been smoking for over 10 years and never burned anything.
As I said, take money for damage - but no smoking clauses are legally unenforcable unless you take pictures of him smoking in the property.

A reply to Darkblue... If it says no smoking in the STA then the tenant should adhere to that. Who was he to damage the property we have worked long and hard to buy. How would you feel if a friend borrowed your car and left cigarette burns all over the seats. I fail to see your reasoning here. I'd politley request you don't leave any more unhelpful and aggressive replies to my question.
You are taking this far too personally.
You are running a business and you dont like one of your customers.
I think you need to seperate your emotions from the property as going forward this will cause much more head and heartache than it needs to.:beer: Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

I was purely asking for some legal knowledge rather than paying a solicitor for it but I think that may be the better solution here. Thank you to those that tried to leave helpful responses.0

I find my opinion and advice constructive. We're all entitled to our separate opinions however.
A bong does not necessarily mean he was smoking it in your premises. Or do you have a clause for smoking paraphernalia?

Does your inventory state the value of the coffee table?
I find it very unlikely that a small claims judge would award you anywhere near replacement value. In the future, best take such items with you or sell them, as tenants will not look after them as well as you'd like and accidents will happen.
Re the floor, do you have original receipts, etc, for the fitting? Again, there is a good reason most landlords elect to use cheaper carpet or vinyl/laminate. the potential of damage is too great. Again not sure what court will think - I think it will really depend on original receipts, inventory and what the tenant has to say in their defence.0 -
I severely dislike when landlords put 'no smoking' clauses in contracts. Who are you to dictate someone's life and habits?
Their property, their rules.
As a tennant I wouldn't want to rent a room that a smoker had previously lived in.
The smell lingers and the residual carcinogens that accumulate on the walls and ceiling can still prove harmful even after the smoker has left.0 -
Next time, don't leave expensive furniture in a rental.
Or if you do, take a correspondingly large deposit!0 -

Please tell me it's a typo and the coffee table is £100, not £1000 - who puts a coffee table costing a grand in a rental property? I know Ikea gets a bad rep for robustness but you can get change out of £50 for one.

So exclusive, I had never even heard of them!We made it! All three boys have graduated, it's been hard work but it shows there is a possibility of a chance of normal (ish) life after a diagnosis (or two) of ASD. It's not been the easiest route but I am so glad I ignored everything and everyone and did my own therapies with them.
Eldests' EDS diagnosis 4.5.10, mine 13.1.11 eekk - now having fun and games as a wheelchair user.0
