Scotland -poor product and service what can I claim ?

What is reasonable for me to claim and do I do it through the courts?
Please advise me?
In 2004 I had new boiler and central heating system installed and took out a further 5 year service contract covering parts and labour. It expires in June 2011.
F E P heat care installed an Ideal Isar HE30. They no longer fit these.
It has had problems from year one and the engineer is in and out in 10 min for the service. Have had heat exchanger replaced alongside numerous other replacements and repairs. They even suggested it was my gas supply. I had it checked and it was fine. Now need the expansion vessel replaced and they are insisting I have an external one fitted. I presume this is because a proper replacement is expensive. I have had a leak and regular pressure loss for several years, they have put leak seal in twice and it is still damp under boiler. The engineer used to fill boiler to 2.5 bar every time he was called out to investigate pressure loss. He no longer works for the company. I refused to have him back when he failed to notice visible leaks from several pipes. No one has stripped the boiler down and investigated all the seals and joins.
I feel I did not get what I paid for a functioning boiler nor are faults properly investigated and repaired. I want a new boiler to replace this one, I am happy to pay the whole sale cost of the boiler but not for labour as a replacement should not be required so soon after having a new system installed. I also want the 5 year cover included as this is offered with new systems by F E P Heatcare.
Have asked the director to call me with no luck and the company will not give me his contact number. The manager can not help.

  • That's the problem. It breaks down again and again and they have never managed to fix it. It has lost pressure from year one. I have not had a six month period with out a fault of some sort.

    You should have had this mindset after 6 months or a year if you wanted a new boiler instead of letting it go on too long.

    Going to agree here. Plus as it's after 6 months, you would need to prove it was a manufacturing fault.

    Why not try getting British gas in to see if they can find the fault and if it's fixable or not?
