    It's obviously fine as you have been drinking it, no illness, no funky smells, no harm.

    Youv'e done you bit getting them to take it down but not sure what else you could want.

    A shop owner from Thanet has been fined £3,465 for selling food beyond its ‘Use By’ date, which indicates when food may become unsafe to eat.
    Krisnnapillai Saseendran was convicted of 21 offences under the Food Safety Act after pleading guilty at Margate Magistrates Court on 9 August. He was fined £150 per offence, plus £300 costs and a £15 victim surcharge, and was ordered to pay within 14 days.
    The offences related to Mr Saseendran's two shops; Spar in Northdown Road, Margate, and Costcutter in the same road.
    The dates on the food varied and the most out of date item was soft cheese 13 days beyond its Use By.
    Mr Saseendran had previously been cautioned by Kent Trading Standards for the same activity, which had repeatedly occurred over at least two years.

  • Re post 15. I think the kety to that story is that he had been warned for repeated offences.

    A supermarket found to have one thing for sale, even if it is several units of the same item, is unlikely to be prosecuted like that.

    Most wrongly use the terms interchangeably so just checking that it was indeed "Use by".

    Altough mistakes do happen supermarkets need to be more careful, email their head office they may give you some vouchers to compensate your hassle of going back to the store.

    I quite often find things out of date (by a day or so usually) at our local supermarkets. I tend to take one off the shelf, put the rest backwards so its harder for anyone else to purchase one and then hand the one I picked up to an assistant who seems to then rush to remove the rest from the shelf.

    If you find that this is happening a lot then keep a note and report them. If its only a one off then just move on and check more carefully in the future.
  • You asked what others might have done in your situation. I was quite shocked that some posts said "get over it".

    From reading your post it seemed that you felt the Assistant Manager was polite but slightly blase. I think what you would have liked was for the Assistant Manager to have been a little more sympathetic and apologetic. You did right in returning to the store and pointing out the error. In a large store I guess you'd expect them to have tighter control over their use by dates but things do occassionally get missed I suppose. Thankfully you and your grandaughter were fine despite drinking the smoothie past its use by date.

    I think the point you're trying to make is that it could have been possible that the item (or any other item past its use by date) could have been harmful, especially to anyone who was vulnerable (child, pregnant lady etc) and that you wanted the assistant manager to acknowledge to you that they were aware of this possibility and they would look into it.
