Boiler Service - Responsibility of Landlord or Tenant ?

Hi All,

I have a tenant moving into my flat in a few weeks, just wanted to check who's responsibility the servicing of the boiler is (annual service).

    You must also have a Gas Safe certificate done annually. A copy of which must be given to the tenant.

    hmmm if you have to ask that kind of question I'm somewhat concerned that you are not aware of your other legal obligations :eek:

    Do you know anything about being a LL or are you an outright newbie?

    As a LL you have to:

    (a) get the boiler ( & any other gas appliances) serviced/checked on an annual basis
    (b) pay for a LLs gas safety certificate
    (c) provide a new T with a copy of the GSC before they sign up or an existing T with a copy within 28 days of a check being done during the tenancy
    (d) retain copies of of the LL copy of the GSC for a minimum of 2 years

    Criminal offences committed otherwise. Google "HSE, gas safety, landlords"

    The costs are tax deductible.

    You may also want to familiarise yourself with s11 of the LL&T Act 1985:
    11 Repairing obligations in short leases
    (1)In a lease to which this section applies (as to which, see sections 13 and 14) there is implied a covenant by the lessor—
    (a)to keep in repair the structure and exterior of the dwelling-house (including drains, gutters and external pipes),


    (b)to keep in repair and proper working order the installations in the dwelling-house for the supply of water, gas and electricity and for sanitation (including basins, sinks, baths and sanitary conveniences, but not other fixtures, fittings and appliances for making use of the supply of water, gas or electricity), and
    (c)to keep in repair and proper working order the installations in the dwelling-house for space heating and heating water.
    Sign up to NLA, RLA or LL Law and familiarise yourself with all of your legal obligations before you sign a T up. These membership fees are also tax deductible , you will have access to much useful guidance, and you'll get discounts on LL insurance premiums.

    Have you got an EPC ready for the property?
    Do you understand the tenancy deposit regulations?
    Have you read through HMRCs PIM500? (Property Income Manual)

    As well as the courses suggested by Artful, your local Council may run sessions for private sector LLs, as part of a local accreditation scheme.

    Have you considerered responsibility for the roof (assuming your flat is top floor)? If a tile slips and leak develops, does your contract specify that the tenant should fix it?
  • There is no legal requirement to have an annual service. The Gas Safety (Installation and Use) Regulations 1994 merely states that all gas appliances are maintained in good order. The only legal requirement is for a Landlords gas safety certificate.

    My posts says "service/check" because people tend to use the two word interchangeably but thanks for the clarification: smiley: The LL clearly won't get a GSC without a check being undertaken

    "...... a person subject to a duty imposed by that paragraph shall—

    (a)ensure that each appliance to which that duty extends is checked for safety at intervals of not more than 12 months by, or by an employee of, a member of a class of persons approved for the time being by the Health and Safety Executive for the purposes of regulation 3(3) of these Regulations; and
