Halifax CC - Can I reclain - very old card

Hi, I be grateful for any advice offered here.

I took out my Halifax CC in 1998 - at the time I was in full time education (6th form).

I have since that time been paying PPI - which I haven't really paid that much attention to as I tended to pay off my CC each month it would never really amount to much (£2 to £10).

I have started traveling a lot with work and also just got married :) As such have over the last 6 months being spending a lot more (still clearing the balance). Since returning from Honeymoon I have noticed the extortionate charges on my account. This month they charged me £59 PPI! For only 3 weeks balance when I payed off the card in full. Needless to say I'm pretty furious that they charged me so much.

Since finding out they charge 78p per £100 - I had no idea as this was not explained to me in 1998. I certainly don't remember this being sold to me or the terms being explained. Besides I was at College (although part-time job).

Needless to say I canceled the PPI and a few internet searches later it appears there may be a slim chance I was miss sold. Do I stand any chance of a reclaim on this ancient card?

    First of all Congratulations to you both on your marriage.:beer:

    And yes I would give it a go with your reasons, just as long as you have the account number then that's good, and it makes no difference on how old the card is, or is settled or active, give it a go.

    You complete a FOS questionnaire, as shown on link below, further down the page as stage 1.
    Complete and send to whoever was responsible for setting up and selling you the policy, and keep a copy....in case you to refer to it at some point.
    They have 8 weeks in full to respond, they may write back to ask for more time, this is okay just as long as you know where you stand.

    You can write a cover letter if you want to, if you feel you want to give more information/to enclose with the questionnaire.

    Many thanks for your advice (and :beer: for the congrats) - I will write to Halifax tomorrow and see where that gets me.

    I have also asked them (on phone) for the original terms of the payment protection that I took out in 1998.

    Your very welcome.:beer:

    If you do require any information on your account, you can if you want to request for a subject access request (SAR), they have 40 calendar days to comply and send all they hold on your account.
    You enclose the payment of £10 cheque or postal order for this request, the SAR is of course optional, but can sometimes help if you need some details to help you on your reclaiming.

    Seems to me that it is quite possible that a claim of mis-selling would be upheld; if you were not employed at the time, it would be difficult to become unemployed. Would you have lost income if you had been sick?

    The main problem here, I think is that the bank may only hold records going back six years and you may find any compensation is limited to that period unless you have kept your statements.

    Just as an update for those interested.

    I sent a letter and questionnaire to Halifax. They responded within a week and have refunded £760 back onto my credit card.

    They have asked if I want to contest this, but I'm pretty pleased with this - infact I'm overjoyed, so many thanks to MSE and the members that helped me,

    Yes, great news. Well done.

    If it has only taken a month from your claim until payment of compensation then I think Halifax should be commended when compared to the hassle others have been put to.

    Should brighten-up Christmas for you this year. :j
