ird homes withholding deposit

I rented a flat in Edinburgh from IRD Homes. I paid my rent on time paid my bills and left in the flat in good repair. The flat was inpected by the Edinburgh manager of IRD Homes the were no issues at the time of inpection. I waited for my deposit and contacted the IRDs Edinburgh manager when it didnt arrive. He told me he had emailed the head office in London about this. After a few weeks i asked him what was happening he then gave me the number in London to contact but after phoning this number i was then transferred to the person dealing with this. The phone was put down on me and I called back only to get the answer machine after leaving my details i have not been contacted. Finding this frustrating i called the Edinburgh manager who then gave me the email address of the person dealing with this. I sent an email explaing my situation and i had been cut off by phone and felt that they are trying to avoid paying me my deposit. What steps can i take to regain my deposit and any expense i occur?

    If they have not notified you to say they are with-holding your deposit due to damage etc then I would write them a letter saying that if they don;t repay your deposit within 7 days you will take them to the small claims court and (if they are a member) you will also notify Arla regarding their behaviour!

    I'm sure someone on here will post soon regarding the legal ins & outs of it all for you :)

    As Mum_of_3 says, you are going to have to take them to court. I'm sure there is someone on here who is familiar with the Scottish court system who will be able to talk you through the process. You should be able to recover the entire deposit and any court costs incurred.

    There is another thread on here where someone had the same issue with these total bar stewards and they received their deposit back before going to court. It seems you just need the courage to pursue them for the deposit and they will fold as they know they have no right to keep it.

    It is interesting to know that they are accepting deposits in their Scottish properties. It must be the lack of Deposit Protection Scheme across the border that makes them think they can get away with stealing other people's money (yes Sunil Dhown and IRD Homes, you are thieves).

  • OP I think you should either amend the thread title to show that it's a deposit in Scotland or send theartullodger a personal message as he's landlord in Scottishland and will most definitely know what the procedure is.

    Stop phoning and emailing and use good old fashioned snailmail. Send two copies of the letter from different post offices, obtaining a cert of posting for both. The letter needs to clearly state "letter before action" at the top, and if they don't respond it's onwards to a straightforward claim via the Sheriff Court. See PM as IRD folk seem to read this board from time to time.
