Advice please CSA mistake!!!

Hi, I have previously posted on here before. The CSA assessed me on CS2 back in May this year but I was supposed to be on CS1 after putting a complaint in they finally admitted their mistake and I am now on CS1.
I have just got off the phone with my caseworker as it went clerical, They are now only assessing me from TODAY!! My caseworker has told me I should have been assessed from September 2009 a year ago but they never sent the NRP a MEF form!!!!!

However I am told I will be eligable for some sort of compensation because of the delays and maladministration and that the NRP is not liable to pay from last year and that the CSA will be. Does anybody know how far I will be backdated as they said I have to consider reasonable delays, but what are reasonable delays in the CSA eyes?

    Not sure how you get to CSA 1 in 2009, but still.

    Suggest that you write in and complain, tell them you are going to take the case to ICE, for them to look into. Then wait and see.

    You may be moved back to CSA 2, as it came in in 2003.

  • Thanks, my case has always been on CS1 the Csa made the mistake my case has been ongoing since 2000.

    If the case has been open since 2000, it can't have been a mistake not to issue a MEF in 2009. There would have been no point.
  • Thats what I thought, but they said because the case was closed for 2 weeks they had to issue a MEF again????? Why I dont know!

    NRP was made redundant from main job but was still a retained fireman he asked me to close it and he would do private agreement after 2 weeks never got a penny so re-opened

    Firstly I don't condone people that will not suppoert their children, but that said if you closed the case! Then it is a new case from when it was reopend, or so I believe! I am sorry to say that i may well be a case of this is 20/20 hind sight! Not much help, pos you should have got the private agreement in place and registered at Court before you closed the case.

    Not much help I know but something to think about!

    If the kids see their father don't try to stop this now as a result of his, shall we say 'Sharp Practice' it is not down to them.

  • According to my knowledge if you re-open a case within 13 weeks of closing then the case remains the same. I never got a letter confirming the closing of my case either and my daughter has chosen not to have any contact with her father either , thanks
  • surely if they put u on CS2 then it will be subject to phasing? Id have thought any child maintenence received would be better than none!
  • Hi Markeymark, They werent supposed to put on CS2 and as for phasing who knows!!! And maintenance, yes any maintenance would be nice, but I havent had any of that either for a year!
