item not arrived + seller dosnt leave fb to get a false score

(soz i got the hump while typing and went on a bit if you dont want full story plz skip to halfway down for my questions)
bit p'd off that a bargain won over a wk ago still has not arrived have mailed a couple of times and reply never answers my Q, ie have they been sent yet? can i have the tracking no. etc?
even explained was for my little boys birthday.(now been and gone and he's still waiting for 1 of his prezzies) so i start digging in her f/b,which on the surface looked ok, looking up what her customers have brought and when they left f/b to judge how long delivery was.seems most people think 20 odd days is quick delivery,are thay mad?? other items i won the same day (sun 17) where here by wed at latest, and this listing states royal mail 1st class recorded 1-2 working days!!! finally tonight she responds to say sorry 4 delay i have sent them, thought you would of got them by now,and b.t.w. i have sent 1st class standard not recorded it was wrong on the ad..sorry :mad:
so i will not get a tracking no. to see if she's telling truth i think she was unhappy at price boots went for and decided to pull out,new listings she has placed have higher start price and it looks like she has done this once b4,but then gave buyer neg f/b when he complained he'd not received. Her f/b reply was she thought he was lying and had kept item, i have 100%f/b and am worried she may do the same.or she just cant be arsed to post them off in a hurry.
:question: can a seller be allowed to state and charge 1st class recorded then send standard??thus no tracking number
:question: also notice in my digging she hardly ever leaves f/b for others and someone told me this is to get an artificially high rating. Is that true??
even if i get refund im still not happy as 1)son still wants his boots 2)gutted he couldnt have them on his birthday 3)doubt i'll find them that cheap again
and its just the principle of it, hate it too when sellers dont leave f/b until after i have!as far as im concerned auction finishes,i pay immediatly ive fulfilled my end of the deal so i should get my f/b if it turned out i was an unreasonable !!!!!! they could always do a follow up. because i feel if i were to complain and leave neg or nuet i will get same back even tho im v. easy going,fair and understanding that there r sometimes probs, i have had broken items b4 that have taken some effort to replace but they have replaced so i gave poz,as yet i have not left anything but poz 4 sellers but really want to this time.

They shouldn't do that and most sellers would refund the difference in what you paid for and what you got, ie 68p. However, it is quite immaterial really as assuming you paid by paypal you can claim back and it is her loss if she didn't send it recorded as she can't prove one way or another whether it was delivered.also notice in my digging she hardly ever leaves f/b for others and someone told me this is to get an artificially high rating. There is no way she can artificially inflate her own FB, her feedback is what people leave her, feedback left for others only counts on the other persons feedback so they don't affect each other at all. Feedback is also voluntary so she doesn't have to leave it at all, but in those circumstances I would not leave that person feedback either.
Just start a paypal chargeback if the item doesn't arrive in today's post if she is unwilling to refund.

As a seller I NEVER leave feedback until a buyer has. As far as a transaction goes, the seller has effectively done their bit by the time an item has been dispatched and satisfactorily received therefore the buyer is in the best position to leave feedback for the seller. Until the buyer leaves feedback a seller does not know that the buyer has received an item and is fully happy with the purchase.
There are unfortunately too many people on eBay that would be extremely happy to leave a negative or neutral for a seller if that seller had already left their feedback because they have carte blanche to say what they want, however niggly, knowing that the seller can do nothing about it.
I think this is the practice most sellers adhere to and based on personal experience I would not advise sellers to do otherwise if you value your feedback rating. I dont agree that a buyer has fulfilled their part of the deal once payment has been made. Its up to the buyer IMHO to confirm receipt and say they are happy with their purchase as well as to pay promptly. I also consider they should leave feedback as part of that deal. Therefore no buyer will ever get feedback from me unless they have left feedback first.
Whilst feedback left could be added to as you say, the rating cannot be changed.0 -

I dont understand the artificially high rating - surely not leaving feedback wont affect hers. With the who leaves feedback first I guess that will open up a whole can of worms on here - its often getting discussed!
I always wait until the buyer has left feedback before leaving mine so I know they have received the item and are happy with it and gives me chance to sort any problems out. As a buyer I always leave feedback on receipt of the item and after having checked it. Feedback is optional and covers the whole transaction - I personally dont consider the transaction over until the goods are received and checked - whether I am the buyer or sellerWeight Loss - 102lb0 -
yeh but dont paypal take back the 15 quid or something and as item was 21+6.95 post i would still be out of pocket.
the price differance in post doesnt bother me i have many times purchased with well over inflated post prices knowing this is how some make the money up for advertising / selling really cheap, the way i look at it if the total comes to what i wanna pay fine, if they choose to advertise 99p + 9pound post when really item would cost about 9 pound and 99p post i dont care if it adds up what i was going to spend.
my beef is opting for the 1st class recorded when im on a deadline thinking that would be quicker and safer and then seller posts it out a wk later by standard.0 -

and she has only returned the favour 26 times 3 of them negs, for what looks like similar prob to mine .
i dont fully get the mathmatical side to the scores and the artificial scoring from withholding f/b was something i read last night on e bay's chat forums,iv'e just tried looking for it again but cant find it.
and what i ment with who goes 1st was not aimed at genuine honest sellers like i say i have never had to leave negative yet,but have seen and heard sellers give neg f/b even tho customer has paid ,waited , and had genuine reason for complaint,then the seller has given unfair and unjust f/b in return to make it look like the buyer was a loser who wants to cause trouble when in fact they have done nothing wrong.
i thought the whole concept of e bay was supposed to be trust and everyone leaves everyone an honest f/b

no the £15 is if raise the claim thru ebay,
as it was a paypal payment, raise a dispute thru them , they dont deduct anything, if she can prove that the item was sent recorded/special delivery by providing paypal with atracking number, then you will lose. if she doesnt/cant supply a tracking number then you will win........
also i think you can inform ebay that the seller has changed the t&c's- not sure how though, i am sure someone will be able to point you in the right directionsmile --- it makes people wonder what you are up to....

Just a thought to give the seller the benefit of the doubt : Give your local sorting office a call as maybe someone tried to deliver the boots while you were out and never bothered to leave a card.
If the parcel is not there start the paypal dispute and as she cannot prove delivery you will win it and get your money back including postage. Good luck.I

postman just arrived with the footie boots
seller has v.high expectations of royal mail- last night she told me she had posted and thought i would of got them by now when looking at the post ticket she had actually only posted them yesterday.9 days after auction finished :rolleyes:
only cost 2.70 too but hey who gives a "?'@ at least my little boy will be v.happy when he comes home from school.0 -

I've been pondering this... I suppose if they never leave feedback, a disappointed buyer may possibly be deterred from leaving an honest neg, as they know she will then be able to leave a retaliatory neg back.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0
