Ombudsman

Can I ask has anyone had their claim sent to the Ombudsman and if so, how long roughly did you have to wait before it was settled and did you get your PPI back or was it not upheld.

Have had a claim in with Loans.co.uk since Feb 2009 have had 4 adjudicators and this present one has sent his proposals to LCUK and they have rejected the claim that I was mis-sold and they now have 3 wks to accept it again then it will go to the OMbudsman.

Am fed up waiting when I see on the forum people have had their LCUK claim upheld and have been paid out think they are just picking on me now lol:o but still I paid £10775 for a loan of £44000 and they are refusing to budge! THe 5 yrs are up next June anyway but still would like the money back x

    It can take quite a while once it gets referred to an Ombudsman. I have been waiting about 4 months now and it still has not been referred. They are very busy. I know that does not help you but be reassured that it is quite normal.

    3-18 months is the current typical. In normal times the FOS would typically be closer to up to 3 months but the volume is hindering their service standards.

    If the other party appeals a decision, then a referral to an ombudman can add many months or even a year to the decision.

If this takes any more than 9 months it will be a waste of their time as the PPI should be paid back to me in June 2011 as that is the 5 yrs up. Do you know what would happen if it takes longer does this hold up them paying it to me anyway or will it mean that it will still be ongoing even though the 5 yrs are up, am a little confused yet angry as i have seen lots of posts on here from people who have successfully reclaimed PPI back from Loans.co.uk ad yet they are not budging on my case i am clueless is this cos they are clamping down on people now or maybe I was one of the last ones to claim? Pass:mad:

    If the ruling is that they have to refund then it will be back to the start. Not the point they looked at the complaint. So, in reality, the only issue with a delay is a) the judicial review works against you and b) it delays the outcome but not the amount paid.

    If you have to claim it back for the 5 year cashback (assuming this is what you mean) and its still queuing at FOS then I personally would make the cashback claim and then IF you do win misselling again this would be taken into account then and any refund (which would be the PPI premium AND all the interest charged on it) would be reduced by this amount.

    With regards to the cashback you only get back the premium after 5 years and not all the interest charged on it for the full term of the loan.

    Yes I do mean that claiming it back for the 5 yr cashback yes I know I would only get the amount paid and not the interest and I would still be paying the same amount for the term of the loan ie a further 20 yrs :( so yep I am really banking on this getting upheld from the Ombudsman and them paying it all back to us thus rebooking the loan and reducing the payments per month by approx £180 a month which would really really help us financially.

    I am hoping fingers crossed that I hear something by xmas as it would be the best xmas ever for my wee boy at the moment we are struggling so much i have to rely on the family presents and can only afford to get him some small things he is only 5 so is still too wee to understand the concept of presents etc.

    Oh the joys eh if I had known now how much this would cripple us I would never have done it :(
