CP Plus - have they actually successfully taken anyone to court

    They'd have to buy loads of clamps. Most PPCs are mail scammers - why waste time and money messing about with clamps when you can send out loads of letters for little outlay instead?
  • as far as I know the only time you can legally be clamped in Scotland is if you are on a public highway, and only then by the Police or DVLA for non-payment of (real) fines. There's nothing on the signs in the car park mentioning clamping.

    I have looked on the CP Plus site, and there are no "case studies" of successful prosecutions.

    Also, I have just heard that the car park is public land gifted to the people of the town where the hospital is built by a philanthropist, and owned by nobody (?). Surely this would make it impossible for anybody to seek payment through the courts? At any rate, the NHS taking patients and its own staff to courts over this might make interesting material for the local media.

    It can't last, 8 cars have already been vandalised by local residents despite being legally parked in the surrounding area.

    Yes, in any court case the claimant has to produce a contract with the landowner giving full agency rights. Otherwise there is no privity of contract.

    It's possible, for a landowner to employ a private parking firm, but for the parking company to lack any rights to make court claims.

    In fact, it's probably quite a widespread situation. Most PPC's have no intention of taking people to court, so why bother with reams of paperwork for no reason.

  • is it possible to mandate the DVLA to not pass on your details to third parties? seeing as they profit so clearly from it. there must be a data protection issue.

    I think its a condition of your V5C and driving licence that they can pass on these details, you don't agree to them you don't have a vehicle and drive .
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    Try tell them and the courts that. They even sell on details where someone claims they own the land when in fact the car owner owns it - there's a thread on here somewhere.

    It's just a nice little earner for DVLA. :money:There clearly needs to be better legislation, but that's probably 100 or more years away the amount of progress there has been in the last 5 years.

    Section 35 of The Data Protection Act allows them to disclose data for the purpose of court proceedings.
