Howard Cohen & Co want to take me to court!

Nightmare
This relates to an old Frasercard that I had. I had a balance of around £400 with Viking Collection Services bought off GE Capital. I phoned them and told them my situation with Payplan and have been forwarding these statements to Payplan every month as told. It was only last week that £165 was also paid off on that card as GE Capital refunded some charges, so it went down to around £260 I think.

I then got a letter from Viking on Saturday saying 'We're taking legal action', and now today I get this. I'm really worried as I wanted to make my first payment to Payplan this week and then move on. Now this has worried me a lot. I'm worried about Bailiffs and I'm worried about getting a CCJ. Does anyone have any advice??

    You need to refer this to PAYPLAN asap.

    Please get some advice ASAP, contact PayPlan about the repayments and see what they think you should do and then the Citizen Advice Bureau as they will help you fill in any relevant paperwork correctly and will advise you as to where you stand legally.

    Hope that helps a bit, please don't worry too much as that won't help anything.

    Unfortunately I found out the hard way with Howard Cohen and ended up with a CCJ by them courtesy of GE Capital Bank. Please get some advice ASAP, contact PayPlan about the repayments and see what they think you should do and then the Citizen Advice Bureau as they will help you fill in any relevant paperwork correctly and will advise you as to where you stand legally.

    There's no way I'm getting a CCJ for £300 odd, it's just not worth it!!!
    That's it 9am tomorrow, I'm on the phone to Payplan.

  • Yeah and thats not to mention the court charges they slap on for such a minor amount in comparison..... glad you've got your head screwed on enough to know that a CCJ is not worth it, good luck with it all and please let us know the outcome.

    a little unclear but if you are entering a DMP with payplan all your debts will be defaulted and will show on your credit record; a CCJ is only marginally worst , why are you so worried...any of your defaulted creditors may choose to apply for a CCJ ..will/can you pay all of them the full amount?

    in any case you didn't really explain what you actually got... a summons or a threathening letter?

    i'm afraid if you go down the route of DMP with payplan you will probably get a lot of threatening letters and phone calls.

    Frightening stuff, but surely as LTD says that this debt was already included in the DMP, then won't Payplan deal with Cohen/GE?

    Absolutely damn !!!!!!it
    I don't mind getting a CCJ for say a £10k loan or an expensive car or if I fell behind on my mortgage
    But for the sake of a few hundred on a Frasercard... that's awful. I can probably afford it if I don't pay Payplan this month, but that will then just delay my DMP starting.
    I think I'll just have some sleep now and see what Payplan suggest.

    I'm not sure... there's a paragraph and then it goes on to say 'A Claim has today been submitted to the County Court for issue. You should respond to the claim asap... Payment in full of £341.47 being the total amount shown due in the Claim including costs, will prevent judgement being actioned against you...'

    So from that the first part looks like they're taking me to court, the second part looks like a 'This is your final chance' statement
