Sample Goods - NOT FOR SALE!!!

Hi All

Just wondered if shops are allowed to do this....

Hubby bought me an UGG bag recently from a reputable shop at an Outlet Village.
RRP £325 - Sale Price £120.
No complaints with the bag or anything, but on closer inspection there is a rather large tag inside the bag which says...
Sample Bag
NOT FOR SALE

Are they allowed to do this?

Yes and no. There is nothing illegal with what they are doing and as long as the goods comply with the SOGA etc. it is not something Trading Standards would be interested in.

However they may be breaching a contract with the goods supplier, by selling on 'sample goods'. In this case the supplier could sue them if they wanted and claim damages (between the cost of the sample costs and what it would have cost the shop to by them wholesale), I doubt they would bother though.
In either case does not prevent the shop being able to pass on legal title to the goods to your hubby (which is one of the lessor known implied terms under the Sale of Goods Act); as even in 'sample goods' title to them would have passed to the shop.

I was in a hairdressers recently that had small bottles of a hair oil on the counter that said samples not for resale.I asked if I could take one.They said no they were £5.What could I do about it? Nothing.

Same with multipack cans that state not for resale on them. Have always wondered why they have been able to get away with this - especially when they sell them for full price too
