Hello,
I ahven't been on here for a while due mainly to my job taking too much time (no really, lol).
Would any of the very kind peeps on here help me out with this little issue?
I recently purchased some leather goods from a shop in London and had to unfortunately return them for a patch job. The shop admitted it was a manufacturing defect but has declared they will not send me the goods back unless I sent them a cheque to cover for the cost of returning them to me (I am not local to London).
I just wanted to check witht he knowledgeable peeps on here where I stood on this. My belief was that if there was a manufacturing defect, then the manufacturer/shop had to cover for all P&Ps...
Any opinion/advice/help is appreaciated on this.
Thank you in advance.

whats a patch job? What did the postage cost?0
-
Thanks for the answers...
postage was 8 pounds: 1.29 for the enveloppe and 6.50 for special recommended delivery, it would prob cost the same to send it back to me.
The "patch job" was on a pair of leather trousers were the leather gave out one week after purchase on the side seam right next to the pocket.
Ok, is there a reference anywhere I can quote next time I call them? Just so they don't start arguing back..."Don't cry, Don't Raise your Eye

I think the OP bought the goods at the shop itself. In which case I suspect they may be entitled to either expect to return the goods at the shop or ask you to cover P&P. You might have been better off asking for a refund...0

a repair is the same as an exchange where faulty goods are concerned and as such you'd expect the retailer to foot the cost of returning the product to you.
if the item was sold online or by mail order then the distance selling regs apply and as such you are entitled to a fll refund as you have returned the goods to the seller with their agreement.
if the seller is now moaning over the cost of returning the goods to you afer repairing the fault, wich i assume was no fault of yours, then i suggest emailing them back saying something along the lines of "no thanks, i'd rather have a full refund, as is my right under the distance selling regs, than pay you twice for the delivery because you sent me a faulty item. If you are not prepared to pay the reasonable cost of rectifying your mistake then please kindly refund my money and keep the item"
i expect they would rather pay the postage than refund you in full,,,,;)......"A wise man once told me don't argue with fools because people from a distance can't tell who is who"........0 -
How recent is "recently"?madfrenchgirl wrote: »I recently purchased some leather goods from a shop in London...0 -
I think CapJ has a good point there: I bought the goods at a physical shop in London.
They do not have an email address nor website and certainly do not sell online. So distance selling rights do not apply there, Toffe but thx for the info on rights ofr distance selling.
Wealdroam: recently would mean a month ago. They stated that they had a one year warranty provided I produced a receipt when claiming (which I did).
Looks like I am gona have to fork it out. The joys of shopping in the big city... not. lol"Don't cry, Don't Raise your Eye

Well under the sale of goods act they are responsible for all cost involved in remedying defective products.
Secton 48B is the relevant section outlining how remedies should be carried out.48B Repair or replacement of the goods
(1) If section 48A above applies, the buyer may require the seller—
(a) to repair the goods, or
(b) to replace the goods.
(2) If the buyer requires the seller to repair or replace the goods, the seller must—
(a) repair or, as the case may be, replace the goods within a reasonable time but without causing significant inconvenience to the buyer;
(b) bear any necessary costs incurred in doing so (including in particular the cost of any labour, materials or postage).
Thats the actual act itself so there can be no argument as to who is responsible (the last point applies here).
Also worth a read of section 14 as well as it outlines your basic rights.
