More than one way of getting points for ESA??

    Yes I could stop claiming JSA and not reclaim ESA and claim what I would lose through Pension Credits.

    The only difference is that with ESA they allow you to try out some work whilst sick (to get you back into work). You are allowed to keep your wages as long as it is no more than £93pw and you work for less than 16hrs pw, without it affecting your benefit.
    You can, if you wish, try out being self employed just as long as your net profit for the year does not exceed £1040.

    With PC, if you want to do a little job you can only keep £10pw of your wages, before they reduce your PC.

    I want to do something instead of sitting down being bored, and this is the way the Government let you do it.

    You have said before that you ride 3 miles a day on your bike and now you are saying 200 yards.

    if you would read my post carefully I did say that I told the JSA people that I could ride my bicycle for 3 miles a day most of the time.

    I then qualified that statement in my post that this was a white lie in order that I would be accepted as fit for work and obtain JSA. Otherwise they would have said that I was unfit and where would I go then? I had had enough of the whole ESA scenario and appeal system as per my post and the only other choice was JSA.
    How many times is the question asked ' been told that I am fit for work as per ATOS, yet JSA say that I am not!'

    The truth of the matter is that I would find it impossible to cycle that distance. The best I could imagine doing is no more than 200yds twice a year and then it would have to be a very good day!
    They obviously wouldn't be able to prove or disprove my statement. But it was said to try and convince JSA that I am fit!!

    I have been there already in Dec 09/Jan10 when I last claimed JSA but was refused the claim and told to go back to ESA.
    I either fit in one box or the other!!!

    Yes it would be a different claim, but I am still ill with the same complaint. There has been no change of circumstances other than to claim JSA because my appeal ceased. Otherwise I would have had no income. Either I am entitled to JSA or ESA - it must be one or the other. Because I failed my medical it should be JSA.

    I wouldn't need new evidence surely as the health/disability situation hasn't changed. Are you saying that I should go back to my GP to get a 'new' sicknote for the same illness? The DWP have a valid sicknote issued in August 10 for 6 months from my GP saying that I am unfit for work.

    I don't need a new illness or a worsening of the old one as it is more than 6 months since I was told that I had failed the ATOS medical and put an appeal in which I have subsequently cancelled, claimed JSA for a few weeks and now am thinking of going back on ESA.

    No, you have misunderstood my previous post. When I said "before" I was referring to you saying on another thread that were able to ride a bike for 3 miles a day and now in this post you say it is 200 yards.

    Sorry, but this is a load of rubbish. I have been told that I'm not (due to various disability issues) able to ride a bike. (well, I could; but for the safety of others, it's not recommended) Yet, this would not stop me from using a computer. How many jobs require you to cycle 3 miles?

    As far as anybody who knows me, believes that that is what I can do! As far as the DWP know (JSA were told to show that I am fitter than I really am to claim the benefit, and ESA were told as one of the many reasons why I closed down the appeal (I was feeling better and able to exercise and look for work). They both believe that that is what I can do. Everybody believes that that is what I do!

    None that I know of. But when you tell people that that is what you can do, it would give an impression that the guy must be pretty fit to do it. Hence, being fit enough to claim JSA instead of ESA, which I had just closed down.

    Thanks for your comments, but honestly this is getting me nowhere. All I am trying to find out is what obstacles do you think I would come up against if I now close down the JSA claim and go back to ESA with the history I have with them from the previous claim as detailed in my post? And what evidence would I need to prove the claim ie, medical certificates etc. (DWP already have one covering 6 months from August despite me claiming JSA and saying I was fit to work.)

    I do not see why you said you could cycle 3 miles a day on another thread on here because this forum has nothing to do with the DWP.

    On the first point, if I walked in to the JC+ office, and when asked about being available for work, I said eh well, all depends on how I am feeling on the day. I have been signed off by the doc until Feb 2011. but not to worry, there must be an employer out there that is looking for a liability to take on.
    There are some stipulations about what work I can do, no lifting, no carrying, no pushing, time off for medical appointments oh and yes, if I look a bit wierd at times - that's because of the amount of Morphine I take every day.

    They would have me out of the JC so quick my feet wouldn't touch the floor. They would laugh when I asked when would I get my first giro and when should I sign on!!

    I had to convince them that I had got better and didn't qualify for ESA anymore. Bike rides - yeah 3 miles a day easy!

    Couldn't get ESA anymore so JSA was the other option.

    As regards the second, I get just over £5pw. Not going to buy much with that!

    So it was either JSA or ESA for the £65pw.

    Why all these questions - all I am looking for is advice on possibly going back to claiming ESA.
