Advice on returned goods

I bought a dvd of the BBC series "Life on Mars" on a buy it now on Ebay for £16.99 including P&P.
When the goods came through the seller had forgot to put the DVDs in the box and the cover wasnt the one scanned in on the listing, it was clearly a copy and all the writing was fuzzy on the back. You could see the crease from the original cover which had been scanned in on a PC or something.
I emailed the seller and explained that as it was a present for my husband for christmas, it was pretty obvious that it was a copy so could I please have my money back.
She emailed saying to just post the box back and she would send the money back , when enough money was clear in her paypal account.
Now Ive checked and her account has been suspended on ebay, but I dont have the goods anymore to inform paypal that they were sub standard and to get my money back.
Im new to posting on this forum and quite a novice on ebay (as you can tell). Is there much I can do?

    Start a PayPal dispute and explain that (presumably) you have posted the goods back to the seller - do it as 'item significantly not as described'. Being already suspended from eBay (possibly for a similar offence) odds should be in your favour over the outcome.

    Unfortunately you might be stuck. If the seller does respond to the paypal dispute they may turn round and say they never received your dvds back, if they do that paypal will ask you for proof of delivery and if you don't have that the case will be closed.

    I know it is easy to be wise after the event, but never send a return without paying extra for tracking, especially where the seller is suspended or selling dodgy goods.

    The only other thought I have is a RM claim...it may well be that the seller honestly did not get the items back, in which case assuming you have proof of posting you can claim for loss against the Royal Mail.

    Did you send the goods back by recorded delivery? Ie, a trackable way? You should still be able to do a dispute and say that you have returned the goods - but whether they can get the money back will be another thing - if the seller has been suspended from paypal and has an empty paypal account?!
