We put our house in Glasgow, up for sale 5 weeks ago and received on offer which we accepted. We agreed on the missives the same week but these still weren't concluded 5 weeks later. We gave our solicitor instructions that if they weren't concluded by friday of last week, we would be pulling out of the sale as our moving out date was on the 15th sept.
Our solicitor contacted us on the Friday and told us that everything had been sorted out and that we could now conclude the missives which we agreed to.
This week, we popped into the solicitors to pay a cheque in and were informed that they wanted us to have a site meeting in regards to the boundaries of the property. We questioned how this was possible as we had been told that the missives were conluded and were informed that the solicitor hadn't actually posted them out yet as there had been a mix up, with her thinking that another solicitor in the office had posted them for her but they hadn't!
Anyway, we received a call from the solicitor yesterday to tell us that the woman had pulled out the sale. This has left us out of pocket by about £700, which if the missives had been concluded, the buyer would have been liable for but because our solicitor hadn't posted the relative paperwork, we have to cover these costs ourselves.
Obviously, we are very unhappy with the way our solicitor has handled the situation but would like help in knowing what we should do next and our rights!!

They are required to have a designated 'complaints person'. Take it up formally with them.
It is very likely that they will resist your claim, even if you are in the right. You might be able to get them to agree to do future work for free up to the value of the sum lost.

cheers for the advice. I will be in for a meeting with the companies main solicitor tommorrow, so I'll let you know how I get on. I just can't get over how incompetent the solicitor has been.:mad:0
