Fonesafe and recurring charges

Hi all
I lost my T-mobile phone whilst on my final day of holiday in Latvia in May.
On returning to the Uk I blacklisted the phone and rang Fonesafe.
I was told that I was not covered because I did not report it to the police in Latvia.
I had assumed that was the end of the matter.
I have since discovered that i am still being charged £9 insurance for a phone that I no longer own.
I rang Fonesafe and asked why.
I was told that one needs to give 30 days notice to cancel the contract.
I retorted that they are charging me for a service that they know they cannot provide (ie cover for a phone that does not exist).
I then asked why I was not told to cancel the policy when I reported the phone as lost. I was advised to read the T&Cs.
The upshot is that i still now still have cover for a non-existent phone until the 4th of October.
Do I have a leg to stand on with regard to claiming back the charges???

I have just rang barclays and they agree that it is resonable to assume that Fonesafe should have cancelled the policy given that fonesafe know that they cannot cover unfortuanately when they tried to get the money back just now Fonesafe refused to let them...

From personal experience I know that fonesafe can be frustrating. You may need to keep at them, but I think its unreasonable to continue to debit money from your account for a phone they know is no longer in your possession and that they refuse to payout for.0

i am considering setting up a web site in the states relaying my experiencea and allowing other to do so too
From my limited experience I know that i will be covered by the first amendment. I will put a note on the site reminding their lawyers that if they send a courier around to my house with a cease and desist notice that they will be guilty of harassment.
based on the advice given here I am also considering suing them for the paltry £50 or so, and then factoring a couple of hundred for my time.
i am so peed of with their attitude that i am also thinking about leaving t-mobile after 13 years0 -
Is it a myth that contracts have to be "fair and equitable"?
Or is it a case of Caveat Emptor?0
