Giving notice...

Basically, can it be done via email? I know I should write it, and I will. It's just that with the weekend and whatever I want to give it ASAP as it's a matter of saving money!

    How will you know it has been received?

    I had a problem at work a few weeks ago where a contractor sent me a load of photos, my email account went nuts and wouldn't accept anymore emails, so people were trying to email me over a three day period (I'd gone on annual leave) and the emails weren't coming through and noone was getting 'bounced' email warnings back at their account. That was a fun two weeks after that sorting out who had tried to send me what!

    Assume we are talking an AST in England & Wales.. and you are sole tenant?? And this is not you wanting to leave at the end of the initial, fixed, term??

    Notice

    If you have a periodic tenancy (which means that the original fixed-term has ended and your tenancy runs from week to week or month to month), you have to give one month's notice in writing, or longer if you pay your rent less often. The notice should end on the first or last day of the period of a tenancy. Once the notice ends, your tenancy ends and you no longer have any right to live in your home.
    If you have a fixed-term tenancy (ie for one year) you will only be able to give notice during the fixed-term if your tenancy agreement says it is allowed. The length of notice you have to give depends on what your tenancy agreement says.
    It is possible to leave on the day your tenancy ends without giving any notice, but this is not usually advisable. It is best to give your landlord notice if you can, especially if you have paid a deposit and need it back.

    However, Landlord may be flexible.. so, send it with a "return receipt" (or similar name) and follow it up with a printed copy which you have signed & dated... post it , keep copy.. but LL/agent may argue they didn't get it until post arrived. Some email "return receipts" come from a server that receives the email not the punter who looks at it so can't be trusted...

    Think of it the other way round.. if LL/Agent gave you notice by email and it didn't suit you to go on the date suggested, might you perhaps decline to accept said notice's validity?? Aye, thought so....

    and some of us deliberately switch off the "read receipt" function;)

    Agree with Artful - notice in writing, good old snail mail with a certificate of posting or hand delivery and ask them to sign to acknowledge receipt.
  • It's periodic rather than an AST at the moment. Will get writing the letter now.
