Has anyone noticed the amount of dca's and companys now issuing CCJ action?
The numbers seem to be going up, why do people think this is?
It is a mystery to me why this could be happening....afterall, it costs the DCA money to take someone to court & its hardly worth their while just to get back £1 per month if anything at all - after the court takes all the persons essential outgoings into account etc..

yes i do agree that if you borrow money you should pay it back, i don't condone trying to avoid paying legitimate debts.
on the flip side of that when i hear reports of people using loopholes to avoid repaying creditors i do tend to think,"what goes around comes around"
banks rip some people off, some people rip banks off, it's six of one and half a dozen of the other and so i tend not to preach to either side, personally.
Couldn't agree more with comment from Toffe. Perhaps we could ALL learn something from Toffe regarding not preaching or JUDGING anyone, as none of us are on the forum for that. Unless of course there are trolls lurking, in which case they should move to another forum or simply not comment!If you've nothing decent to say, perhaps you shouldn't say anything.

Further to my above reply...
What seems to be happening is that the DCA will use sneaky tactics & go for the CCJ by default/without the person even being aware that they have done this.
The next thing the debtor knows is when the official notice comes through the door from the court itself.
Its a relief then that we have a process called "set aside" that people can take full advantage of when DCA's do resort to such tactics.0 -
I think Mr Ton makes a good point. if we are being preached at by trolls that we have a moral duty to repay all debt then surely the banks and lenders/dcas have a moral duty to be totally fair above board. ie not telling lies on the phone, twisting the law to their advantage and not the debtors, using confusing tactics or bullying letters, or using things like bulk processing centres to process ccj's rather than the debtors local court.

I agree eyeopener2 - when the banks repay everything they owe to the taxpayer, then the industry can preach its morals - until then, it just all sounds a bit ridiculous quite frankly....0
