please help...phones4u insurance

Hi all,
this is my first post so hope someone can help... I have held mobile phone insurance with phones4u company premier plan for years even though my last phone hasnt been through them thinking they were giving me a good deal, anyway my phone was accidently put in the washing machine and as i have water damage sent it off to the insurers thinking they would fix or replace and that would be it as my last experience with insurance went smoothly. anyway after paying out £50 excess and paying to send my phone back i received it back "fixed", same phone but was working again, about a month and a half later my phone starts doing funny things, shadow over the time, not accepting charge so i took it to apple, after they looked at it they showed me there was still water damage and opened it up to show watermarks inside still, advised me they should never fix water damage and wrote me a report to say so. phone up premier plan to advise of this and they advised me that i had 28days to say if something was wrong so would need to make another claim, after trying to explain the reason my phone was doing this is because they hadnt fixed it in the first place and i couldnt see inside to see the water damage still, they advised me that i had sent the phone not working and it came back working so they had done the job required?? saying i wanted to speak to a manager and would take this further if i had to they finally agreed to pick it back up and replace. now thinking when they said replace i would recieve a new phone i was happy with this as afterall this is what im paying for?? the phone comes back and is a different colour, suspecting that its not new i take it to apple who have a look and confirm my thoughts, not only that they havent used genuine apple parts on this refurbished one, its full of dust and they have removed a lot of the inside stuff apple use as guidelines as well as a do not remove sticker apple put in. i decided to contact my insurers once again who say they only replace and it may not be brand new, after finally getting through to a manager, they advise that im not insured for colour and that they replace with the same specification or better, i paid an extra £80 to get the 3gs as 3g didnt have the white i phones so in my opinion the white is the better spec, also as long as it works thats all that matters?? but this phone has missing parts and non apple parts which i deem is not same spec as my old one?? the manager is now arranging to get this picked up so she can look however i dont hold out much hope and will put a letter with this detialing this and my intentions, just wondered if anyone knows where i stand on this??? what my rights are?? i have said i will be takling this to the financial obudsman which is why they took it back the last time but any advice/help would be much appriciated to get back what i think it what i am entitled to for paying their premiums!!
