Deposit

Hello! I've previously posted on here re the appaling LA I used to rent my house through. This is now all in the hands of TPO. The tenant's moved out of the house (moved in with her bf), and she instructed me to keep the deposit as payment as she bought the furniture that was in the house from me. However,the LA didn't do anything with the deposit paid for some 10 months after the previous tenant moved in (therefore breaking their contract with me, which stated that they'd put the deposit into an appropriate scheme within 14 days of the tenancy starting). If TPO decides to compensate for this, would it be to me, or the tenant?

    It is your responsibility as a LL to ensure that your T's deposit is scheme-registered, so always chase your LA up within a month of a new T moving in. If the deposit was finally registered after 10 months, it will still be flagged up as the T's money. You will need to get your former T to confirm to the scheme's administrators that the money is to be repaid to you.

    I am not sure why you might think that the TPO would compensate anyone on a account of your LA being exceptionally tardy with the deposit registration. Where is your loss?

    Yes, the law says within 14days of receipt but unfortunately LLs are getting away with late registration, when taken to court by their Ts


    Letting Agents are unregulated and many of them are unqualified, untrained, with few specific skills. It should not therefore come as a surprise that some of them seem incapable of meeting the terms of their own contracts with the LLs whose interests they are supposed to protect
  • As one of these 'accidental landlords' I wasn't aware that I had to chase them up, as they did a good sales job on me and assured me that they'd handle everything and the tenant didn't tell me that she'd been chasing them for this info since moving in. It was only after I started chasing the LA that they eventually did this. There are various elements in which they broke the contract, and ignored solicitors letters, which is why the case has been taken on by The Property Ombudsman, as that's they're regulatory body. The deposit has already been paid to me.
