Landlord changes mind why do we have to pay.

this is long sorry

We have been stung by a LL that my husband signed for not me by the way but it has both names on it. Surely I would of been told to sign as well.

They said they where doing a credit check on us but he provided everything they took £50.

Signed missives and paid a month and and a month but on it, its in both names I didnt sign anything. Still havent signed anything.

We then got dropped the bombshell about my dog being pregnant and felt it right to let them know about this, then the landlord not us changed their mind about letting us in.

Husband went back to get our money back and we lost out on over £300 as a holding fee. Surely if this is the case we should of received all money back as it wasnt us that changed our minds about the property the landlord did. We would of happily taken the property cos they allowed pets in it. They state we changed our minds when we clearly didnt.

It is written down in black and white that they dont want the pregnant dog in their property so released us from the tenancy.


Husband took a witness with him to get money and he was told if he didnt sign a piece of paper detailing what he got back he would get nothing.

It is a lot of money for them to keep and they didnt even market the house at all it was my chance we found it as we went for another property that already let. So they offered us this one. Now this has fell through.

So legally where do we stand.

    There is a lot of difference between agreeing to one dog and agreeing to a whole troupe of dogs. Your situation has now changed dramatically.

    A lot of your post doesn't make that much sense, you seem to be saying they want to hold the money yet in the next breath you're saying your husband was offered the money provided he signed the reciept confirming the funds were returned, which by the sound of it he wouldn't do for some reason?

    As they state they allow pets did they specify what kind of pets and how many? You’d expect that somewhere in their terms and conditions there’ll probably be something limiting the pets or perhaps some get out phrase such as at their discretion or subject to refusal. Yeah, you’d expect them to have covered themselves for precisely this kind of thing. However if not then perhaps you have a case and so perhaps consider threatening them in writing about this and that if they don’t cough up within 10 days you’ll be doing a small claims court action which, if I remember rightly, costs you about £40 to lodge and you can do it yourself over the net. Except that bear in mind that if you do this and they defend themselves using expensive lawyers and then you lose you could, worst case, get hit for hundreds or even a grand or two of costs. Of course their costs could be nothing or only £100 or £200 as it’s a relatively small issue but it’s still a gamble. It’d be awful to lose and get hit for a lot, wouldn’t it. Except that they can’t do much or anything about collecting it off you so you can probably just ignore it if they do try to charge you. On the other hand if they don’t defend themselves then you can win by default. So all a bit tricky and a headache and a gamble. Good luck with whatever you decide.

    Have you tried going over their heads and talking to the boss(es)? Sometimes a boss will over rule the workers in order just to avoid trouble if you make it clear that you’re not taking this lying down and that you’re going to go all the way. Sometimes this attitude works, other times you can just get rudeness and threats back and they hang up the phone, so it’s up to you how much nervous energy you want to put into this. So maybe start polite rather than going in guns blazing. You can raise the temperature later if you want to but initially you might get better results if you start off diplomatically.

    Do you want to breed dogs or is the pregnancy accidental? If the latter then perhaps it’s time to consider getting Missy sterilised.
