HMV - returning an item!

Hi All
I bought a DVD for my daughter for her birthday only to find she got a duplicate and as I'd got the receipt and the item was unopened etc I thought I could return this to HMV for a full refund. But oh no, their policy is to give credit notes not refund the item. It was undamaged, completely as it had been bought. Can they do this? The man in the shop was very rude and I shant be shopping there again.

I know if you buy it online you get a refund, surely its the same when you go into the store.

I would get in touch with trading standards, HMV are full of crooks who flout the SOGA. We should get the police involved in the matter and show how much we detest this attitude and throw the staff in the cooler for the weekend, as we, the proletariat empty the shelves of their good in reparations for the sins.

There is no right under any act, statute or rule that shops have to even give a refund purely because you change your mind.
Offering a credit note is actually beyond their legal requirements.

I've been caught out by this before. Because MOST major highstreet shops offer returns (above and beyond what they have to legally) I assume all do, and was a bit taken-aback when HMV refused to refund an unopened TV. However as noted above, legally they don't have to! There's nothing you can do to get a refund I'm afraid.0
