Resigning or Getting Sacked?

I may be out of a Job soon. Will know on tuesday (i work part-time becos im a full-time student). I have pulled one too many sickies and work have decided to discipline me.

If i get sacked is it still possible to obtain reference from them?
Am i entitled to any benefit at all even tho im a FT student. I have too many outgoings u see but i do live with parents.

  • I hope for your sake that you won't just be sacked on the spot. Discipline usually means a verbal warning first, then a written warning if it needs to be done again, before you can be sacked. A bit of grovelling might be needed to hang on to your job for the time being. Keep your nose clean for a while to make sure of a refernce, then look for another job. Good luck.

    You can put anyone you want down as a reference but it is always up to them to decide if they will actually give you one or not.

    Contrary to urban myth it is perfectly legal to give someone a negative reference however if the person felt the reference was inaccurate they would be entitled to sue the person for deformation. Given that a reference only helps the new employers there is little reason for a company to run the risk of giving a negative reference (short of personal grudges but in companies the size of Tescos all references are vetted/ written by central HR and so grudges would get out). Effectively there is an almost unwritten rule that rather than giving a negative reference you refused to give one instead. That way the requester knows there is something negative but the previous employer cannot be sued for anything.

  • You are not entitled to Employment protection until you have worked for a company for minimum of 12 months.

    However it is good practice to talk to any employee prior to any "sacking" taking place. But in this instance as you have accepted that you threw one to many sickies you are ready to face the consequences.

    Once you have served 12 months, you are subject to the companies disciplinary procedures and they have to conform to the law.

    Reference........I wouldn't give you one.
  • first of all if you have pulled too many sickies ( a term usually referred to as faking an illness) the i would certainly sack you on the spot. and as for a reference i wouldn't give you one on the behalf that you havent been a reliable member of staff. and i believe you're not entitled to any support from the government. you can always ask for a reference whether they give you one is up to them but it has to be fair.
  • i admit i have pulled a few fake sickies but on the flip-side i am confident in sayin that i have treated the company better than they have treated alot of their employees including myself. I aint bearin a grudge but i hav told them i have been making a conscious effort to improve on absences ever since the problem was highlighted to me. My argument was that the issue was never addressed (until i amassed around 18,000 bradford points) so i assumed everything was fine.

    18,000 :eek: over what period? Unless you have a lot of genuine illness, that is not " a few" sickies!

    Surely you didnt get to 18k without any disciplinary hearings or even informal 'chats'? If so that is very poor management - you would have been sacked long ago in our place if no underlying medical condition

  • thats just it leigh-anne i did random sickies every other week and they didnt say anything. I guess i just got into a routine. There were no informal chats or personal-improvement plans. This lasted for about 18months until this june where my line manager told me to sort my act out.

    However i did do a genuine sickie at the end of august which has prompted the disciplinary.

    Where: S is the number of occasions of absence in the last 52 weeks and D is the total number of days’ absence in the last 52 weeks.

    So, for employees with a total of 14 days’ absence, for example, in one rolling 52-week period, the Bradford score can vary enormously, depending on the number of occasions involved.

    So, for example:

    one absence of 14 days is 14 points (ie 1 x 1 x 14)
    seven absences of two days each is 686 points (ie 7 x 7 x 14)
    14 absences of one day each is 2,744 points (ie 14 x 14 x 14)

    A score of 18,000 in a year would be about 26 one day absences in a year, about one day off every other week.
