Divorce. Draft Contract not send after a month

We had an offer accepted on our new purchase about 4 weeks ago. I just checked with our sols and still no draft contract received frmo vendor.

I understand the vendor is going throgh a divorce and was wondering if the draft contract would name the beneficiaries and possible the split they would receive? So, could it be that even though there is apparently no onward chain, its actually tied in to the divorce of the vendor? i.e. If they disagreee on who should get what, then we could be waiting months or years for a family court to decide ?

Or maybe I'm just over worrying as usual !

I know of divorce cases where it had to go back to court for a Judge to decide which estate agent to use for the sale of the matrimonial home. And that was just the start!

With divorcing couples it is common that one is eager to get their hands on the money and the other still living in the house does not want it sold. I think you need to say you will pull out after a certain time if there is no progress. If there is a real desire to sell they should get on with it promptly or explain the delay as they will not want to lose a buyer. If you don't get a response it would probably be time to walk away from this one.
  • Tell them if you don't get a draft contract in 7 days you will pull out.

As a retired conveyancing solicitor I believe the information given in the post to be useful assuming any properties concerned are in England/Wales but I accept no liability for it.
