I've told the garage I don't want them to fix it I just want a report so they know they won't be getting any work out of it. I spoke to VOSA last night and this is what they advised I should do. If it does turn out to have been a dodgy MOT I need to phone them back and they will come and do an investigation - they say they can't help me get my money back for the repairs though so I need to speak to the dealer themselves or go to trading standards.0 -
I would bet good money that all of the £1,100 worth of repairs are things which Kwikfit specialise in.

Once you get your report from your usual garage, give a copy to the garage that sold you the car asking them to pay up or do the work. You would be expected to give them the chance to put things right if you ultimately decide to go to the small claims court. If they know VOSA are going to investigate, this could encourage them to repair the car thoroughly - another check with your usual garage, to make sure the work is OK, afterwards would be advisable. The seller should agree to pay for both your garage's reports before they start any work.
The fact that the garage sold you the car without a warranty is, to some extent, irrelevant. What matters more is "What are your statutory rights?" under the Sale of Goods legislation? The legislation covers used cars so they should be of satisfactory quality, fit for purpose and as described e.g. a full and recent MOT clearly implies all the things checked under an MOT are compliant with the SoG legislation requirements. But there is a grey area in that dealers who use the word "trade" in their advertising or title appear to be less liable than other car traders; maybe it has something to do with low value cars, but £1500 may not be classed as low value. A point which may be relevant in your case. For advice on this point and your whole situation, you probably have a telephone lawyer advice service included in one of your insurance policies - car or home for example - so try that or the Citizens Advice Bureau.
Keep on to VOSA - their evidence could be very useful later to support your claim against the supplier of the car, whether in court or not.

PS I agree with the comments about Kwik Fit finding things to do - wouldn't rely on them alone, but their advice may not be entirely useless.0 -

Why on earth did you pay Kwikfit to do all that work???
You now have the issue that the new garage you're using won't be able to say whether the work Kwikfit did was valid or not, so although they can write a report on remaining issues, they can't vouch for anything Kwikfit "fixed". You will also need to get a report from Kwikfit with their list of faults, along with the work they did, but in reality, you should have just paid for an independent report, and given the initial garage the chance to put everything right.Should've = Should HAVE (not 'of')

I needed to get the repair done asap as I was 250 miles from home when the exhaust sheared off, so it was done as an emergency to get me home again. I have spoken to the garage who are writing a full report/second opinion. Whilst they have said that Kwikfit have fabricated some of these faults, they are actually correct on some of them, however they have discovered other faults , the main being that it is only running on 3 cylinders instead of 4. So they've said that the car is too dangerous too drive and as such I have to keep it there until I sort it out.
So after this I decided to call the dealer and calmly explained the situation to him and asked him what we could do to sort it out. He said he wasn't prepared to help and that the car was 'sold as seen'. I told him it is illegal to say this and if he was unwilling to help I has no choice but to go to VOSA and Trading Standards as the car was not fit for purpose. He hung up on me. I tried to phone again, he hung up on me. Well that says it all.
So I phoned trading standards who have told me to send him a recorded delivery letter giving him 7 days to rectify. They told me he has committed all sorts of offences. I'll update again when I hear any more.0 -

Kwikfit are notorious though, i went in once to get something minor done just because it was convenient to drop in and they said i needed a few things sorted. My boyfriend owns and runs a garage so he took my car so he could get his lads to look at it to discover that everything Kwikfit told me needed doing was absolutely fine. One of the things i remember was that they told me the alternator belt needed replacing, 12 + months on and it's still working fine. They also told me my front brakes needed replacing and they were also fine. In fact i think they told me one or two things would be an MOT fail including a few warning lights that sometimes come on on the dashboard. When i bought the car the garage i bought it from told me that the sensor was faulting and not the thing the light indicates, it had already been MOTed since then and wouldn't have passed if there was actually a fault. I had my car MOTed in July at my local council garage because my boyfriends garage was super busy and it passed with flying colours, including the warning light thing so there definitely wasn't any of the problems Kwikfit claimed. They clearly just thought, 'here we go a blonde girl who won't know anything about cars we can fleece her over'. Little did they know that i spent several years in the TA in a transport regiment so happen to know a lot about cars and my boyfriend owns a garage.0
