Fit for purpose

Hi can anyone advise me, my new house is a week over the 2yrs warranty and the main roof has started to leak. Rang Wimpy house builder they told me buying a house does not come under fit for purpose rule is he right?

yes.as fit for purpose is in the sale of goods act..houses do not apply to the act.. should you not have a 10 year warranty under the home buyers scheme?

Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
If you are planning to upsize the new house will cost more.
If you are planning to downsize your new house will cost more than it should

Geoff is right you should have your certificate for NHBC for the additional 8 years.

Damage to the roof covering or the structural elements of the roof, which is caused by a defect, is covered (subject to exceeding the minimum claim value).
Damage caused solely by storm-force weather conditions is not covered (see Storm damage below).
So only if caused by defect, if is a lose tile etc you will not be covered as it is more than likely storm damage.0 -

Not sure if is storm damage of bad workmanship as I was on holiday but I know it rain for a good few days. Yes got nhbc cover but I think it has to be over 1K before you can claim ( will check the paper work later tonight). But hey thanks for the help really appreciated it guys.... might have to get a ladder to damage a few more tiles to make it up to over 1K

Make sure you compy with H&S when you climb up there: use scaffolding, not a ladder; wear a hard hat; have a 2nd person present; etc etc
