If it was not working when you first received it, you should have been able to reject it and get either a refund or a replacement. I wouldn't have stood for having it repaired.

As it now still has the same, I would be pushing for that. If the company are refusing to respond to your letters, then you have a couple of options. One would be the Small Claims Court (which I'm afraid someone else will have to give you more detail on). The other, if you paid by credit card (or some debit cards) would be to get the card issuer to do a chargeback to the company.

    How did you pay ?

As Esqui says if you paid by credit card then the Consumer Credit Act, Section 75 makes the credit card company jointly liable. Make a claim on them for your money back. You certainly have sufficient evidence that you tried to sort it out with the company first.

I'm guessing that an online sale would have been done by card. Credit cards have the best protection, but if I'm not mistaken, some debit cards offer similar facilities?

  • we paid by debit card, apparently we have to send the pc back to do a laim back so that may be the next thing to try but I am aware that they have our pc and our money then...the pc company have flatly refused to communicate with us I will be looking into small claims thanks for all your replies guys!

    I tend to agree

Visa debit cards offer a charge back service where they take the money back from the suppliers bank. There is a time limit of 120 days if I remember correctly and there is no legal obligation on them to help.

I believe master card operate a very similar process.

So that covers most cards would it not? Dont see many switch/solo cards these days.
    Back by no demand whatsoever.
