Switching estate agents as a buyer

Hi everyone - this is my first post on the MSE forums...:j

I have a vendor/ estate agent problem. My offer on a property has been accepted and land searches, survey and mortgage all done and ready to go and the deposit is in the bank.

At the last minute the vendor as gone on holiday and has hold her solicitors to 'put everything on hold'. It turns out that they have a problem with the mortgage for the onward sale. We really need a property and are quite keen on this one.

However we want a property pretty pronto and are considering another place. This other place is owned by a private company and advertised by both the original estate agent and a second agent. We have seen this property with the first agent. We don't want the first agent to know as they have completely lost interest in the vendor and are not advocating this property any longer. If we were to make another offer on a different property I think we will lose our first choice.

Can I make an offer on the second property through the second agent without the knowledge of the first?

Any help much appreciated :)

    Of course you can,.

    HOWEVER - would it not be simpler to tell the first EA that you can't keep waiting so want to view the other property? They may get word to the vendor and speed them up or at least make them aware of your situation. I do not understand these clandestine approaches - there really is no need.

    We have seen this property with the first agent.
    If the 1st agent has already introduced you to the property, then they will be entitled to their fee from the vendor, even if you subsequently make an offer via the 2nd agent - who will also want their fee. So you will be making things very awkward for the vendors who might not be aware until they receive bills from BOTH agents!

    Why not be straight-forward? Tell the 1st agent you are unhappy about the delay and wish to make an offer on the other property. At the same time make it clear that if the vendors of the original property progress the sale, then you'll Exchange on that.
  • Sound advice given by G_M. Depending on the vendors contract it is usually 'first past the post'. As the first agent introduced you to the property it is likely he will have claim to his fee even if he/she has not earned it by being proactive. Be honest and open and explain your concerns as EA's are only human. Although we may act as we are on another planet sometimes!
