**** need advise, pretty please***

Hey there,
Tried to get a buddy from the list but no reply, can anyone tell me what to do next?
I've followed the instuctions on the website to the letter and managed to get Hallifax to offer me £300 (even though it's nearly £900 they owe me in overdarft charges)
I know it says on this website to refuse the offer & hold out for full amount
BUT
A) how do i do that, do I just ignore the letter or do I write to them & say "no thanks, CU in court" ?
B) While all this letter swapping has been going on, they've charged me another £150, my letter states I need £900 but now should be £1150,
how do I change the amount I'm asking for ??

    i dont understand the buddy/list type thing but...your maths doesnt work out 900 + 150 = 1050. i know it'll seem pedantic, but i've made boobs like that before when you work summit out wrong once then make an a$$ of yourself using that number for ages.

    anyways good luck and i'm gonna go climb back under my rock.:D

    this buddy thing-i found last wk on main forum, u put your postcode in & it gives u email addresses 4 other people with similar probs.

    no problem sweetie, i presume it's claiming bank charges? are you following the steps as in the article on the main page and on the site they send you too?

    what i'd do is send the next letter on the list after the time limit you've given them and add a paragraph to say you are adding on charges made since you started claiming, then bung them into your breakdown at the end with the others. i added a paragraph into my letter before action about them sending me a letter saying it will be resolved in six weeks i (foolishly) gave them the time and on the very last day of it they sent another letter to apologise that i hadn't heard but with no new time frame. said how disappointed i was etc.

    I'm assuming here you mean the consumer action group web site ?

    I also assume you've reached the point where you've started the court proceedings - hence the offer.

    As with all these things, the final decison is yours but as a pointer, I don't think anyone has gone all the way to the court room although you MUST remember, it could go this far.

    Personally I wouldn't change the amount (if you have started proceedings) but I would write them a treating this £150 as a new claim.

  • if its any comfort, I got back oer £2K earlier this year from Natwest.

    I compared it to a game of poker, with both sides waiting to see who would blink first.

    Bear in mind that the last thing that the banks want is a clear ruling on this because it would open the floodgates or they'd be directed by the judge to refund everybody. At the same time though, they're not going to make it easy for you...

    Hi Fanny
    What stage are you at with your claim? If you are not yet at the stage where you have filed with Moneyclaim you can still add on the additional charges. Just add them onto the bottom of your spreadsheet. Do not accept a third of your charges back. You are in charge of the timetable, you have given them the chance to respond in a positive way, ie by returning all the charges, they have chosen not to so press on.
